32 | take down the wooden castle C1 was building. At this point, C1 became angry and said, “you ruined it, I am going to beat you up!”. The teacher spoke to C1 about C1’s behavior, right and wrong and the children “simmered down”. Confidential interview also disclosed when the children went outside to play later C1 was chasing a group of children the teacher told C1 to "simmer dow"n again, but when C1 got to C2, C1 jumped on C2, they rolled and C2 got a scratch on C2’s face. Other information provided to LPA disclosed that initially C1 accidentally knocked down C2’s castle while playing in the classroom and C2 then attacked C1 leaving scratches on C1’s forehead and jaw, however, at the time, the teacher that witnessed this thought the children were playing and did not intervene even though C1 was screaming and saying C1 though C1’s neck was broken. Once the teacher realized they weren’t playing, she immediately separated the children and attended to the child that was hurt. Confidential interview revealed that both parents were verbally notified the day of the incident and an ouch report was completed later. Records review revealed that during the time of the incident eight (8) children and one (1) teacher was present and that the classroom was operating within ratio. Although the incident did occur, there was no violation of any regulation.
Based on confidential interviews and records review, the allegation that staff did not prevent day care child from being injured by another child, may have occurred, however is not supported or proven by evidence. Therefore, the allegation is unsubstantiated. A copy of this report, appeal rights and Notice of Site Visit were provided to Director.
The Notice of Site Visit was posted by the Director prior to LPA leaving the facility and the Director was reminded this notice must be posted for 30 days. |
