On September 19, 2024, at 1:46PM, Licensing Program Analyst (LPA), William Chancellor arrived unannounced to Childrens Choice Academy: Vista (CCC) and met with Shannon Spencer, Regional Director to discuss the investigative findings of the allegations listed above. On August 6, 2024, at 11:31AM, LPA conducted a tour, took census of the CCC and gathered evidence relevant to the investigation. During the investigation, LPA made observations and conducted confidential interviews with five staff (S1-S5).
On July 31, 2024, a complaint was received alleging that School-Age children commingling with infants. Four of four interviews corroborated that the previous employee school age children were present in the CCC and were left unattended by parent with infant aged children. Three of three interviews corroborated that the school aged child in the photo belonged to a previous staff and was left unattended with daycare children present.

Additionally, it was alleged that the facility is operating beyond the limitations listed on the license. Children's Choice Academy: Vista at 739 OLIVE AVE does not have an active School- Age license at this location and therefore is automatically operating beyond the limits of the infant license. Three of three interviews confirmed that the school aged child was left unattended for more than thirty minutes on two separate occasions, interacting and holding infants and was not under the direct supervision of their parent.

Based on confidential interviews conducted during the investigation and records reviewed, the preponderance standard has been met. Therefore, the above allegations are found to be substantiated. California Code of Regulations Title 22, Section 101161(a): Limitations on Capacity and 101438.2 Outdoor Activity Space for Infants are being cited on the attached LIC 9099D. Per Health and Safety Code 1596.8595, the facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days.



An exit interview was conducted, a copy of this report, LIC 9099D & appeal rights, along with a Notice of Site Visit was handed to facility representative, Shannon Spencer. Notice of Site Visit must remain posted for 30 consecutive days.
