32 | moved to a different class either to visit before being transitioned to the class or to accommodate staff schedules and ratios. One (1) out of four (4) staff interviewed, reported the facility has occasionally operated out of ratio for approximately one (1) to two (2) minutes during child transitions.
It was alleged that staff do not properly supervise day care children, specifically on 02/27/2025, in the TK classroom when Staff #5 (S5) was distracted by paperwork and not properly supervising children. S5 denied being distracted by paperwork and did not recall any incidents. S5 stated visual supervision is conducted at all times and she was not attending to other responsibilities while supervising the children.
It was alleged that on multiple unspecified occasions, staff did not give daycare child #1 (C1) an opportunity to nap. LPA interviewed four (4) staff who confirmed that nap time is not a part of the daily schedule in the Kindergarten classroom, due to the children’s age of a least five (5) years; however, explained a sofa is available in the classroom for the children to use if they are tired and need to rest. The director stated this is communicated to parents and advised that children do have the option of returning to the TK classroom to nap if needed. Regulation states all children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center, however, a napping space and a cot or mat shall be available for each child under the age of five. Children interviewed confirmed they do not take naps in the Kindergarten classroom.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Exit interview was conducted and the report was reviewed with Assistant Director, Sylvia Cardenas.
