On 5/23/2025 at 11:40 a.m. Licensing Program Analyst (LPA), Cindy Meier conducted an unannounced complaint inspection to deliver the findings for the above allegations. LPA met with Facility Representative, Assistant Director Sylvia Cardenas, and advised director of the purpose of the inspection and conducted a tour of the facility. There were sixty-two (62) children, and eight (8) staff present during the inspection.

During the course of the investigation, interviews were conducted with staff, daycare parents and day care children. Documents obtained during investigation included facility roster, personnel record, attendance sheets, incident reports, and staff attendance records.

It was alleged that on 02/27/2025, staff were operating the Transitional Kindergarten (TK) classroom out of ratio. According to regulation, one (1) teacher shall supervise no more that twelve children. LPA’s review of attendance sheets and staff schedules for 2/27/25 indicated ratios were being maintained. The director stated the philosophy of the school is an open classroom concept and children are occasionally

moved to a different class either to visit before being transitioned to the class or to accommodate staff schedules and ratios. One (1) out of four (4) staff interviewed, reported the facility has occasionally operated out of ratio for approximately one (1) to two (2) minutes during child transitions.

It was alleged that staff do not properly supervise day care children, specifically on 02/27/2025, in the TK classroom when Staff #5 (S5) was distracted by paperwork and not properly supervising children. S5 denied being distracted by paperwork and did not recall any incidents. S5 stated visual supervision is conducted at all times and she was not attending to other responsibilities while supervising the children.

It was alleged that on multiple unspecified occasions, staff did not give daycare child #1 (C1) an opportunity to nap. LPA interviewed four (4) staff who confirmed that nap time is not a part of the daily schedule in the Kindergarten classroom, due to the children’s age of a least five (5) years; however, explained a sofa is available in the classroom for the children to use if they are tired and need to rest. The director stated this is communicated to parents and advised that children do have the option of returning to the TK classroom to nap if needed. Regulation states all children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center, however, a napping space and a cot or mat shall be available for each child under the age of five. Children interviewed confirmed they do not take naps in the Kindergarten classroom.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted and the report was reviewed with Assistant Director, Sylvia Cardenas.
A Notice of Site Visit was given and must remain posted for 30 days.
