On 9/20/24 at 10:10 AM Licensing Program Analyst (LPA) Keturah Lane visited the facility to conduct an annual inspection. Upon arrival LPA met with Acting Assistant Director Maddie Howerton and proceeded to tour the facility. During today's inspection, LPA observed a total of 28 infants/toddlers in the following classrooms:
  • Infant B classroom had 4 infants with staff member Vilma Iraheta
  • Infant C classroom had 8 infants with staff members Debbie Cancellieri and Natalie Barut
  • Toddlers classroom had 16 toddlers with staff members Gwen Smith, Stephanie Sanchez, Hilda Namadmalhaghigh and Elizabeth Witt

Appropriate ratios and capacity were observed. Appropriate care & visual supervision were also observed during the inspection. At approximately 10:20 AM, LPA observed infant C1 sleeping on her stomach. The infant did not appear to be in distress and breathing normally. LPA reviewed LIC9227 infant sleep plan for C1 and observed the roll over section (Section C/D) had not been completed by parent or provider. This area must be signed once child is able to fully roll over from back to stomach and stomach to back. Staff member stated that the child could roll over. LPA verified this information with the parent of C1 via e-mail while at the facility. LPA requested that LIC9227 form be completed by parent and e-mailed to LPA as soon as possible. LPA also observed some parents were signing the LIC9227 roll over section if infants could roll only from back to stomach. LPA advised that this section should ONLY be signed if infant can roll over from back to stomach AND stomach to back. LPA advised that it is important for this form to be completed the same (or very next) day the roll over observation is observed. (See LIC9102 TV…) (continued on LIC809-C...)

At approximately 10:40 AM, LPA observed a child’s handwashing sink with blue tape around the faucet. Per acting assistant director Madeline Howerton, the sink has not been functioning properly for a couple days and a work order was submitted 9/19/24, and maintenance should be out to fix the sink early next week. There are two other sinks in the classroom (adult size) for washing after diaper changes and a separate food service sink. Until the handwashing sink is fixed, the staff have been helping the children wash hands at the adult sinks. LPA advised Madeline Howerton to send documentation sink was fixed to LPA Lane via e-mail.

All infant furniture & equipment are age appropriate and in good repair. There are no walkers, bouncy seats, exersaucers or jumpers in the room. Feeding tables have broad-based legs, plastic seats in good repair. There were no high chairs present. Hazardous materials are inaccessible to children. Bottles, dishes and containers of food brought by infant’s authorized representative are labeled with the infant’s name and current date. The changing table is within arm's reach of sink. There is no potty-training in any of the infant rooms. Caregivers wash hands before and after each feeding and each diaper change. Toys are safe, with no sharp edges, splinters or protruding points, nor small parts that can be pulled off and swallowed. Floor mats and cots are available for infants able to climb out of cribs. Cribs or napping equipment are available. Bedding is identified and stored separately for each infant. Napping infants are under visual observation by staff and the napping area is separate from the play area. Indoor activity space is physically separate from other components. Facility maintains individual feeding plans for each infant and has up to date Infant Needs and Services Plans for each infant on file. Sleep logs were reviewed and are on the Kindercare app as well as sign in and out sheets.

Outdoor play area is a fenced playground with sufficient material for cushioning. There are no bodies of water at this facility. Climbing structures, swings and slides are securely fixed to the ground. Area has canopies and trees used for shade. Equipment is age appropriate. Area has drinking water readily accessible, and grounds are free of debris. At approximately 10:50 AM, LPA observed the doors leading to the water heater on the toddler playground were closed but unlocked. Madeline Howerton stated the lock was broken and a work order had been placed to get the lock fixed. (continued on LIC809-C...)

LPA reviewed medication storage and found it to be in order. Personnel records contain health screening documentation and at least one staff member has current CPR and First Aid certifications. All staff have completed mandated reporter training and required immunizations. Infant care teachers meet educational requirements. Sign ins were reviewed via app. Children’s records contain admission agreements and medical assessment. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.
Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.



LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
