25 | On 08/08/2024 at 9:20 am, Licensing Program Analysts (LPAs) Gabriela Hernandez and Anastasia Flores conducted an unannounced case management visit in regards to an unusual incident report received on 07/22/24. LPAs met with Director Monique Gapuz, to discuss the reported incident. LPAs toured the facility, reviewed records and conducted interviews with 3 staff.
LPAs were provided a video footage of the incident. LPAs observed the following on the video. There were 6 children with S1 and S2 on the carpet in the corner of the classroom. LPAs can hear S1 and S2 encouraging the other 5 children to physically harm C1. This incident happened for approximately one minute. The facility initiated disciplinary action for S1 and S2.
Based on interviews and records review, the facility is cited for violation of Title 22, Section 101223 (a) (3), Personal Rights. See LIC809D for cited deficiency.A Civil Penalty of $500.00 was assessed for this violation of Title 22 Regulations. See LIC 421BG.
An exit interview was conducted. A copy of this report, 809D, LIC421BG and appeal rights were reviewed and handed to the Director.
The Director was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
If the facility receives a Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. |
