On 7/2/24 at 10:05AM, LPA Patrick Ma made an unannounced visit to initiate an investigation, for the complaint received on 6/27/24, regarding the above allegations. LPA met with Director, Freda Simmons. Present at the facility were 14 daycare children and 5 Teachers and Aides. LPA conducted staff interviews, received a copy of children’s roster, and reviewed relevant documents and files.

Based on the observation facility equipment is not being maintain in a safe and/or sanitary condition. LPA observed both diaper changing table vinyl cushions were torn with foam filling exposed. Also, LPA ran water in both sinks for a minute and neither had hot water.

Investigations interviewed determined facility is not properly sanitizing bottles, protecting infant food from contamination, or using proper infant feeding procedures. Facility receives clean infant bottles from families every Monday, staff wash the bottles and nipples in the classroom sink with dishwashing detergent and air dry before reuse throughout the week then returns all items to the familiies on Friday.

Regulations require child care center to sanitize the bottles by dishwasher or a sterilizing method outlined in Section 101427(n).

Investigations interviews determined partially used prepared infant formula bottles have periodically been saved and refed/offered later in the day. Per CDC website, (https://www.cdc.gov/nutrition/infantandtoddlernutrition/formula-feeding/infant-formula-preparation-and-storage.html), "Throw out any infant formula that is left in the bottle after feeding your baby. The combination of infant formula and your baby’s saliva can cause bacteria to grow." LPA advised, per CDC, to use prepared formula within 2 hours of preparation and within one hour from when feeding begins.

Also, interviews determined infants are placed on their backs and provided a bottle if they can support it on their own which is a potential hazard to children in care. Infants must be placed in a highchairs or other appropriate seating equipment during feeding. Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff for feeding.

The allegations are valid because the preponderance of the evidence has been met, therefore, the above allegations are found to be SUBSTANTIATED. The deficiency is being cited on the attached LIC 9099D.

Exit interview conducted and report was reviewed with the Director Freda Simmons. A notice of site visit was given and must remain posted for 30 days
