32 | The child exhibited signs and symptoms consistent with heat stroke. According to Weather.com, the high temperature for Lemon Grove, California, on August 29, 2025, reached 93 degrees Fahrenheit. The licensee reported arriving at the daycare at approximately 4:00 PM after picking up children from school. She stated that she parked the vehicle in the driveway and entered the daycare through the garage, while the children entered through the front door. The licensee stated that the vehicle was turned off, including the air conditioning and the windows were rolled down. Licensee stated she made a mistake and was distracted on the day of the incident. Licensee stated "nothing like this should have ever happened".
The preponderance of evidence standard has been met therefore, the allegation that the licensee left a daycare child unattended in a vehicle is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 3) is being cited on the attached LIC 9099D.
A civil penalty of $500 for absence of supervision was assessed. Refer to LIC42IM.
LPA informed Licensee, Rebecca Maxwell that this report dated November 12, 2025 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA informed Licensee, Rebecca Maxwell to provide a copy of this licensing report dated November 12, 2025 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Licensee, Rebecca Maxwell with form LIC 9224.
A Notice of Site Visit (LIC 9213) was given to Licensee, Rebecca Maxwell and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Appeal Rights (LIC 9058) were provided. Exit interview conducted and report was reviewed with Licensee, Rebecca Maxwell. |
