The Reporting Party is adamant that the injury of 12/23/2021 to child #1 occurred due to a lack of supervision by the Licensee and the adult helper. The Licensee and the adult helper admit that the incident occurred at the day care but that it was not due to a lack of supervision. The Licensee and the adult helper stated the children are supervised and that child #1’s incident was an accident.
It was reported that on November 3, 2021, child #1 sustained a bump on the forehead while at the park with the Licensee, adult helper, and other day care children. It was reported that child #1 was climbing on the rope play structure at the park when another day care child shook the rope and child #1 fell to the ground hitting the forehead. It was reported that the incident occurred due to a lack of supervision by the Licensee and the adult helper. Child #1 told LPA that he did not tell the Licensee or the adult helper about the incident. The child was not taken to the doctors for the bump. The interviews revealed that the Licensee, adult helper, and the other children did not observe the incident with child #1 at the park. The Licensee and the adult helper stated child #1 nor any other child sustained an injury at the park. The Licensee and the adult helper denied the allegation. The Reporting Party is adamant that the incident occurred with child #1 at the park due to a lack of supervision by the Licensee and the adult helper. The day care children and day care parents did not disclose anything inappropriate at the facility or with the Licensee or adult helper. The parents stated they do not have any issues or concerns with the facility or the adult helper. The Licensee and the adult helper denied the allegation that the incidents occurred due to a lack of supervision. The Reporting Party is adamant that the incidents occurred due to a lack of supervision. The Licensee admits that the injury of 12/23/2021, to child #1 occurred at the day care but denies child #1 sustained an injury on 11/03/2021 while at the park.
Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that “Staff failed to adequately supervise day-care child resulting in injuries.” Therefore, the allegation is found to be UNSUBSTANTIATED meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. An exit interview was conducted and a copy of the report along with the appeal rights were provided to the Licensee, Lisa Brown. |
