On 5/12/2025 at approximately 10:25 AM Licensing Program Analyst (LPA), Julieta Abrego conducted an inspection to conclude the complaint investigation regarding the above allegation. LPA met with licensee Olga Rodriguez and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were five (5) children and one (1) staff present during the visit. Four (4) of the children were infants, the facility is within ratio.

During the investigation, interviews were conducted with all pertinent parties, including the licensee, staff, children and authorized representative. In addition, LPA reviewed staff and children's files, obtained a copy of a children's roster, and reviewed photos.

Licensee admitted neither she nor her staff observed the child ingesting the “wiggly eyes” and admitted not reporting the incident to the child’s authorized representative or the Department. Licensee stated she became aware of the incident when she received a photo showing the child had ingested the items. Licensee stated

after becoming aware of the ingestion, she did find some “wiggly eyes” in the daycare area carpet and picked them up. LPA reviewed photos confirming the child ingested the “wiggly eyes”.

Based on licensee’s admission, and photos reviewed, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Per California Code of Regulations (Title 22, division 12 & Chapter 3) two Type B citations are being cited on the attached 9099D page.

Exit interview conducted and report was reviewed with the licensee, Olga Rodriguez. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
