On 9/9/21 at 1:50 p.m., Licensing Program Analyst (LPA) Casey Gulley arrived to conduct an unannounced inspection to deliver complaint findings. Upon arrival, LPA met with licensee to discuss final findings on allegation that construction may be a hazard for daycare children.

During the course of the investigation, interviews were conducted with the licensee, facility staff, daycare parents, a contractor and neighbors. According to interviews, the licensee hired a contractor to build an additional play structure on the premises. The licensee denied the allegation, stating she installed temporary barriers located between the play area and construction area to prevent children from entering the temporary off-limits area. On 07/22/21, during facility tour, LPA observed construction materials and power tools located outside the facility's gate in an area inaccessible to children in care. Construction of the play structure was completed on 8/27/21 and the licensee has removed the temporary barriers.

Due to conflicting statements and the lack of supporting evidence, LPA is unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

No deficiencies were cited. An exit interview was conducted with the Licensee and a copy of this report, along with Licensee Rights (LIC 9058 01/16), were provided. LPA provided a Notice of Site Visit (LIC 9213), which must remain posted for 30 days. LPA observed that the LIC 9213 was posted during the inspection.
