On October 5th, 2023, at 7:50 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted a complaint inspection regarding the above allegations. LPA advised Licensee Bertha Salcedo of the meeting's purpose and granted LPA facility entry. The Licensee and six (6) children were present. The helper arrived during this inspection. Language Link Operators 16700 and16462 provided Spanish language translation.

The investigation involved facility tours conducted on 08/30/2023, 09/15/2023 and 09/21/2023. The investigation also involved interviews with the Licensee, residents, staff, children, daycare parents and outside source witnesses.

It was alleged that the Licensee is serving expired milk to children in care. The Licensee denied that expired milk is served to children. The Licensee and staff stated that they look at the expiration dates on the contained milk. They also stated that they taste the milk prior to serving it to children.

It was alleged that the Licensee left children unsupervised. The Licensee denied children are left unsupervised. Both the Licensee and staff stated that either the Licensee or staff are always with children if not both are present with children.

It was alleged that the Licensee forced children to eat vomit. The Licensee and staff denied that children have been forced to eat vomit. Both the Licensee and staff stated that children have not vomited onto their plates.

It was alleged that the Licensee forced a pacifier into a daycare child’s mouth. The Licensee denied that a pacifier was forced into the mouths of any daycare children. Staff also denied that a pacifier has been forced into the mouths of any daycare children.

It was alleged that the Licensee left daycare children in a soiled diaper for a long period of time. The Licensee denied that any daycare children have been left in a soiled diaper for a long period of time. The Licensee and staff reported that diapers are checked and changed at about every two (2) hours.

Due to conflicting statements and obtained contradictory information, the above allegations have been determined to be unsubstantiated. A finding that the complaint is Unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

A notice of site visit was given to the licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Licensee/Appeal Rights (LIC 9058) was provided to Licensee Bertha Salcedo. Exit interview conducted and report was reviewed with the Licensee Bertha Salcedo.
