On 02/20/2025 at 01:00 p.m., Licensing Program Analyst (LPA), Victoria Hernandez conducted an unannounced complaint inspection to deliver the findings for the above allegation. LPA met with Licensee, Maria Herrera, and advised licensee of the purpose of the inspection and conducted a tour of the facility indoors and outdoors. The licensee and two (2) staff and nine (9) children were present during the inspection.
During the course of the investigation, a tour of the facility inside and outdoors, interviews were conducted with licensee, staff, daycare parents, and daycare children. The facility roster was obtained and reviewed by LPA.

It was alleged the Licensee is not keeping backyard free of hazardous items. The licensee denied the allegation, stating she cleans the backyard daily and if she or her staff see any hazardous items they throw them away. LPA interviewed Staff #1 (S1), who stated that the backyard is cleaned daily before the children arrive. S1 explained that a thorough inspection is conducted each morning and evening to ensure the area is safe, with a staff member always present to supervise the children.

During facility inspection conducted on 12/20/2024, LPA observed ample space for children to play, a reading nook, and a variety of outdoor activities available for the children. No trash, debris, broken toys/equipment, or other hazardous items were observed in the area.

LPA interviewed two (2) children. Child #1 (C1) stated they had never seen any toys or equipment broken in the backyard. Child #2 (C2) stated that they only saw a broken swing once, but Licensee ensured it was fixed and put back the following day. Parents interviewed expressed a high level of satisfaction of the care the licensee provides and had no concerns.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to alleged incident. LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted and the report was reviewed with Licensee, Maria Herrera.

A Notice of Site Visit was given and must remain posted for 30 days.
