Licensee's behavior poses a risk to the care of day care children

On 07/20/2022 at 1:10PM, Licensing Program Analysts (LPAs) David Miller and Martha Malane conducted an unannounced complaint inspection to deliver the findings on the above allegation. LPA advised Licensee Rose Dorvilus of the inspection’s purpose. Present in the home was the licensee's helper and nine (9) children; one infant, four preschoolers, and four school aged kids. The licensee arrived at the facility at 1:32pm

It was alleged that the Licensee disciplined her own children in front of the daycare children. Interviews were conducted with the reporting party, licensee, two helpers, daycare children, licensee's children, and daycare parents. Outside Agency report was obtained and reviewed. The licensee admitted to discliplining her own children, but not in the presence of the daycare children.

Due to conflicting information/statements obtained during the course of the investigation, the allegation is determined to be unsubstantiated.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. No deficiencies cited. An Advisory Note Form LIC 9102 was issued to the licensee.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted and report was reviewed with the Licensee, Rose Dorvilus
