On February 23, 2024, at 9:40am, Licensing Program Analyst (LPA), Vicky Williamson conducted an unannounced annual required inspection and inspected facility for the purpose of a capacity increase. LPA met with Licensee, Jonas Franck and disclosed the purpose of the inspection. Also present was licensee's son age 2 years old. At 10:15am, licensee's assistant Mariana Present arrived to the facility. There were no daycare children present. Days and hours of operation are Monday through Friday, 6:00am - 9:00pm.

This is a single level three bedroom, two bath home. LPA accompanied by licensee toured the inside and outside of the home. The following areas are used for childcare: living room, dining room, bedroom #2 (daycare room) and the bathroom #2 (hallway) The off-limits areas are the kitchen, bedroom #1, bathroom #1 (inside of master bedroom), bedroom #3 and the patio. The off-limits areas are made inaccessible to day care children by use of doorknob covers, door locks and a safety gate. Licensee stated that a local park is utilized for outdoor activities for the children. Licensee is reminded that there must always be direct supervision while outdoors and/or at the park with the children. Licensee stated that he understood.

The fire extinguisher, smoke detector, and carbon monoxide detector meet requirements. All cleaning compounds, medications, and other hazardous items were inaccessible to children during the inspection. Licensee has a working cell phone in the home. The licensee has age-appropriate toys and play equipment available. Licensee stated there are no bodies of water on the premises. Licensee stated there are no firearms or weapons in the home.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Pediatric CPR/First Aid certification for licensee is valid through 1/2026 and for assistant 12/2025. Licensee and assistant have the required immunization records on file. Mandated Reporter training certification for licensee is valid through 1/5/2026 and for assistant 12/1/2025. LPA informed licensee to ensure the mandated reporter training is completed once every two years. LPA observed the required documents posted. A sample of children’s files were reviewed and were determined to be incomplete for Identification and Emergency Information (LIC 700),Consent for Medical Treatment (LIC 627) and Affidavit Regarding Liability Insurance (LIC 282). There was no documentation of fire/disaster drills available for review during time of inspection.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep
LPA reviewed PIN 20-24-CCP regarding Safe Sleep with licensee. Licensees stated that he understood.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA and licensee discussed and reviewed the following: Report suspected child abuse and neglect, form LIC 311D, maintaining children’s records according to regulation, posting required forms. Licensee is reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. Licensee was also provided information regarding SIDS, Lead Exposure and Shaken Baby Syndrome.

On this date, 2/23/2024, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

LPA discussed and provided Licensee with the following: childcare advocates email address: childcareadvocatesprogram@dss.ca.gov. In addition, for general questions or questions regarding licensing requirements contact the Child Care Licensing Duty Line at (619) 767-2248.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. To receive important licensed - related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication.

LPA advised the Licensee that prior to making alterations or additions to the home or grounds, the Licensee shall notify the Department of the proposed change.

Per California Code of Regulations, Title 22, Division 12, Chapter 3, deficiencies are being cited on the attached LIC 809D.

The agency received a granted fire clearance approval on 1/31/2024.

LPA and licensee discussed the maximum number of children for whom care shall be provided when there is an assistant in the home, including children under age 10 who live in the licensee's home shall be either: Twelve (12) children with no more than four of whom may be infants and 8 older children over the age of 2 years or Fourteen (14) children, with no more than three infants (birth to 24 months) and at least two of the children with 1 child enrolled in kindergarten and 1 child at least six years of age with landlord consent (LIC 9149).



Licensee does not have Property Owner Landlord Consent (LIC 9149) on file. The licensee is reminded, that care can only be provided for 12 children. Twelve (12) children with no more than four of whom may be infants and must have a qualified assistant.

A Large Family Child Care Home license may be issued upon final file review and completion of the following:

- Proof of fire/disaster drill conducted and documented.

- Complete Children Records for seven (7) daycare children and include Identification and Emergency Information (LIC 700), Consent for Medical Treatment (LIC 627) and Affidavit Regarding Liability Insurance (LIC 282).

Licensee stated that he will submit proof of corrections, no later than, 2/28/2024


An exit interview was conducted with Licensee, Jonas Franck. A copy of the report and Appeal Rights were provided to the licensee. Notice of Site Visit (LIC 9213) was given to the licensee and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
