Licensing Program Analyst (LPA) D. Sanchez made an unannounced Case Management inspection in response to the increase of capacity request. LPA was greeted and allowed entry into the facility by Mercedes Rodriguez Perez who was advised of the purpose of today’s inspection. Inspection was conducted in Spanish language since provider is a Spanish speaker only. There were seven (7) children one (1) staff and provider were present in the facility during this inspection. This facility is a single story, three bedroom, one bathroom house. Licensee accompanied LPA inside and out of the facility during this inspection.

Daycare areas includes: Living room, dining room, kitchen, bedroom located next to hallway bathroom, bedroom located next to the living room, hallway bathroom and front yard. Off limits areas includes: bedroom located at the end of the hallway to the right. LPA noticed that all required notices, License and forms were properly posted. The house smoke and carbon monoxide detectors are operable and fire extinguisher is fully charged. The day care bathroom was inspected; the toilet and faucets are operational. The kitchen drawers are secured and chemicals are not accessible to children.

A review of all adults living in this home who require caregiver background checks have received criminal record and child abuse clearances or exemptions. First Aid and CPR are up to date. Provider stated that they do not have hand gun or ammunition in this house.

Per new Senate Bill 792 pertaining to immunizations, which require all adults in daycare operation to have proof of immunizations for; Measles, Pertussis or Whooping Cough and Influenza or Flu, LPA has verified that licensee has verification of required immunizations and is in compliance.

Assembly Bill 1207 Mandated Child Abuse Reporting. Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years.

During facility inspection LPA noticed there were 4 infants, 2 toddlers and 1 school age children present. Facility is out of capacity, due to provider taking care of 4 infants plus three children at one time with a small license capacity. LPA discussed with provider the maximum capacity for a small family child care home: four infants only (infants mean any children under 24 months); or six children with no more than three infants; or, with landlord consent, eight children with no more than two infants, one child in kindergarten or elementary school and one child at least age six, including children under age 10 who live in the home.

An increase of capacity for a Large Family Child Care Home license may be issued upon final file review.

California Code of Regulations, (Title 22, Division 12 & Chapter 3), are being cited on the attached LIC 809-D.

Upon Receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.

An exit interview was conducted with the licensee. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.

LPA provided notice of site visit and observed it being posted at the facility.

Provider stated that she will ensure to not to have more than 3 infants at one time with the small license capacity. Provider will send a written statement to the San Diego Child Care Regional Office (SDCCRO) advising that she had read and understood section cited.

Based on LPA observation, licensee’s admission, and record review, licensee did not comply with the above regulation, as provider was over capacity caring for seven children (four of whom were under 2 years old) all at one time which poses an immediate Health and Safety risk to children in care.
