On April 26, 2024, at 10:15 a.m., Licensing Program Analyst (LPA), Gloria Gonzalez conducted an unannounced case management inspection for the purpose of a capacity increase and met with the Licensee, Khadro Dahir.  LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee.  Licensee accompanied LPA inside and out of the facility during this inspection. The granted fire clearance for 14 children was received on 4/23/24 with special conditions as follows:
A battery powered alarm and actuation device is permitted as temporary until a hardwired or
permanent alarm and actuation device can be installed. Deadline for a hardwired or permanent alarm and actuation device to be installed is July 23, 2024. The temporary powered alarm and actuation device is subject to a monthly test/inspection by the fire inspector until the permanent alarm and actuation device is installed. The applicant agreed to the conditions. No daycare children and no staff were present in the facility during this inspection.  Licensee meets immunization requirements. Licensee assistant did not meet immunization requirement. This two story, three bedroom, three bath townhome was toured and inspected. The hours of operation are Monday through Sunday,from 12:00 a.m-11:00 p.m.

Applicant will use the following areas for child care: living room, dining room, downstairs bathroom #1, kitchen, backyard patio, upstairs bedroom #1 and #2, and bathroom #2. Off limits areas include: upstairs master bedroom, bathroom #3, and garage. They are made inaccessible to day care children through the use of doorknob covers, and a safety gate. Licensee was advised children must be supervised when using the upstairs bedrooms and bathroom.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements.  All hazardous items were inaccessible to children. The licensee has toys, play equipment and materials available.  The upstairs is gated off at the bottom of the stairway and the applicant understands the gate must be in place when children under five years are present during day care hours. The home has a fenced backyard available for outdoor activities. LPA did not observe any bodies of water and licensee stated there are no bodies of water at the time of this inspection. Licensee stated there are no weapons in the home.

A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.  Licensee’s First Aid and CPR certifications expire on 8/2025.  Licensee completed Mandated Reporter Training on 4/7/23. 2 of 2 children’s records were reviewed and contain immunization documentation and Notification of Parent’s Rights form.

LPA provided and discussed the following:  Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions.  Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.  Licensee was also provided handouts with information regarding upcoming Safe Sleep Regulations/SIDS, Lead exposure and Shaken Baby Syndrome.  LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov

Applicant was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA advised that prior to making alterations or additions to the home or grounds, the applicant shall notify the Department of the proposed change. Applicant states they are financially secure to operate a family child care home for children and will comply with all regulations and laws governing family child care homes.

LPA discussed the maximum number of children for whom care shall be provided when there is an assistant provider in the home, including children under age 10 who live in the licensee's home and the assistant provider's children under age 10, shall be either: Twelve (12) children with no more than four of whom may be infants or Fourteen (14) children, with at least two of the children with 1 child enrolled in kindergarten and 1 child at least six years of age and no more than three infants, with landlord consent (LIC 9149).

Because the applicant rents the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord.

The applicant has not obtained a signed Property Owner/Landlord Consent form (LIC9149). Without this consent, the applicant understands that, once licensed, they can operate with a maximum capacity of 12 children.

No deficiencies cited.

The following correction is required:
  • Helper shall meet immunization requirement.

Once correction has been made a Regular Large Family Child Care Home license maybe issued upon final file review. An exit interview was conducted with Licensee, Khadro Dahir.  The licensee was provided a copy of their report and appeal rights (LIC 9058).  LPA provided notice of site visit, (LIC9213) and observed it being posted at the facility.
