On March 7, 2024, Licensing Program Analyst (LPA), William Chancellor arrived unannounced to, A Rising Star Academy Childcare Center (CCC) and met with Director Danielle Strickland.to discuss the investigative findings of the allegation listed above. On February 7, 2024, at 11:30 AM, LPA conducted a tour and census of the CCC. During the investigation, LPA conducted confidential interviews with five staff (S1-S5) and collected pertinent documents relevant to the investigation.

On February 1, 2024, a complaint was received alleging, Parental Rights were violated, specifically that parent 1 (P1) of child 1 (C1) was requesting personal health information, records of injuries and center fee information directly from CCC and CCC staff was not returning the requested information. Three of three interviews with staff, confirmed that messages from P1 requesting said information were given to the owner. Interviews with owner revealed access to information was only being granted with parent 2’s (P2) permission because no record of a court order was on file. Confidential interviews and record review also revealed, P1 was never contacted directly by CCC owner to clarify court order stipulations and CCC staff were instructed to not release information to P1.

Based on confidential interviews conducted during the investigation and a review of additional pertinent information obtained, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be Substantiated. The facility is being cited under Title 22 Regulations, Section 101218.1(a)(B) Admission Procedures and Parental and Authorized Representative’s Rights. See LIC 9099-D for cited deficiencies.

An exit interview was conducted, appeal rights discussed and given to the licensee along with a copy of this report was provided to Program Director Danielle Strickland.

Admission Procedures and Parental and Authorized Representative’s Rights: (a) In accordance with the child care center's individual program, policies and needs, the licensee shall develop, implement and maintain an admission procedure that enables the person in charge of admissions to: (2) Conduct one or more personal interviews with the child’s parent or authorized representative… (B) Provides the child's parent or authorized representative with information about the child care center that shall at least include the child care center's admission policies and procedures, activities, services, regulations, hours and days of operation, fees, procedures to be followed should the child become ill or injured while at the child care center, and procedures for conducting inspections for illness.

Licensee will provide a training to all staff regarding 101218.1(a)(B) Admission Procedures and Parental and Authorized Representative’s Rights and provide documentation of training and staff attendance. Licensee will also provide a written declaration to LPA, stating understanding of said regulation including a printout of training provided including a sign-in sheet.

Based on interviews and record review the Licensee did not provide information to P1 of C1 requested personal health information, records of injuries and center fee information from the CCC and information was not shared with P1 because of a temporary restraining order on file and not a court order. Confidential interviews revealed that information was only given to P2 and not P1, without permission of P2 which is a potential health and safety risk to the children in care.
