On 12/6/24 at 8:40 a.m. LPA Renita Rodriguez made an unannounced complaint visit for the complaint received on 10/21/24 for the purpose of delivering findings on the above referenced allegation. LPA was greeted by Assistant Director, Brittney Mccray. There were 107 children in care with 16 staff. Investigation visits were conducted on 10/29/24 and 12/6/24, regarding the allegation of “Staff does not provide sanitary bathroom accommodations to day care child".

During the investigations on 10/29/24 and 12/6/24 evidence was obtained, and investigative interviews were conducted. Documents obtained and reviewed included the roster, facility handbook, and roster for the children. Appropriate accommodations regarding toilet training and toilet training supplies were not provided by the facility, as it was corroborated that at least one child was made to sit bare bottom on the bathroom floor during diaper changes. Per Assistant Director proper procedure, which was taught to staff, is to change child’s diaper or pull up first, while standing or on changing table, before allowing a child to sit on floor to put on the rest of their clothing.

There is a preponderance of evidence to prove that the alleged violation occurred. The allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be SUBSTANTIATED.

Exit interview conducted and report was reviewed with the Assistant Director Brittney Mccray. A notice of site visit was given and must remain posted for 30 days. Failure to post notice of site visit will result in an immediate $100.00 civil penalty.

Assistant Director states diaper liners have been purchased and placed in all rooms that provide diaper changing or potty training. Per Assistant Director Staff has been informed that the liners are required for all diaper changes involving children in care moving forward.

Based on interviews, licensee did not comply with the section cited above, at least one child was made to sit bare bottom on the bathroom floor during diaper changes which poses a potential health, safety and personal rights risk to persons in care.
