On July 25, 2022, at 1:10 PM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the findings to the above allegations. LPA met with the Facility Director, Jacqueline Serrano. Present are forty three children with eight staff.

Through the course of the complaint investigation, LPA toured the facility, reviewed pertinent information, conducted several confidential interviews with the facility representatives, seven staff, former staff person, ten day care children, and seven day-care parents. During the complaint investigation inspection, LPA observed several drinking/water fountains throughout the facility and in the classrooms, the children’s water bottles and/or Sippy cups. LPA observed the children’s potty training supplies.

The facility representatives and the staff denied the allegations. The staff stated the children are given plenty of water to drink and that there is no designated water time as alleged by the Reporting Party. The staff stated the children that are being potty trained are kept clean and dry and no child was left with a soiled pull-up.

The Reporting Party is adamant that the allegations occurred. However, it could not be determined whether the allegations occurred or not due to conflicting information obtained from the interviews and a lack of evidence. Several day care children and several day care parents did not disclose anything inappropriate with the facility.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that the “Staff are not offering day care child water throughout the day” and “Day care child is left in soiled pull ups.” Therefore, the allegations are found to be UNSUBSTANTIATED meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Jacqueline Serrano. The Director was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
