On September 1, 2022, at 1:25 PM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the findings to the above allegation. LPA met with the Facility Representative, Rosa Johnson. Present were forty children with eight staff.

Through the course of the complaint investigation, LPA toured the facility, reviewed pertinent information, and conducted several confidential interviews with the facility representatives, seven staff, thirteen day care children, and eleven day-care parents. During the complaint investigation inspections and unbeknownst to the staff, LPA observed the staff and staff person in question interacting with the children. LPA did not observe anything inappropriate with the staff or staff person in question at time of investigation inspections.

The facility representatives, staff and staff person in question denied the allegations. The staff stated the staff person in question has a loud voice that carries but that the staff person in question was not pointing and angrily yelling at the children in their faces as alleged.

The staff and staff person in question denied that the children were crying and not being consoled as alleged. There are two doors with windows that lead into the two year old classroom. LPA observed one of the door windows, to the two year old classroom, was partially covered with a paper. The facility representatives and the staff stated the window is partially covered due to the changing table being next to the window and children’s privacy during changing time.

The Reporting Party is adamant that the allegations occurred. However, it could not be determined whether the allegations occurred or not due to conflicting information obtained from the interviews and a lack of evidence. Several day care children and several day care parents did not disclose anything inappropriate with the staff, or staff person in question or the facility.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that the “Staff yelled at day-care children.” Therefore, the allegations are found to be UNSUBSTANTIATED meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Representative Rosa Johnson. The Representative was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
