On March 23 2022 at 10:23 AM, Licensing Program Analyst (LPA) Anastasia Flores met with Pink Tower Montessori, Director, Chandani Jayasinghe to deliver the findings of the above allegation. On 02/18/22, LPA’s L. Almarez and N. King conducted a health and safety inspection of the facility and no immediate concerns were noted. Copies of childcare roster and staff roster were obtained. Interviews were conducted with five children (C1, C2, C3, C4, C5) and three staff.
On February 11, 2022 this agency received allegation that the childcare staff inappropriately disciplined a child while in care. Confidential interviews disclosed that S2 lifted C1 in the air by one arm and spanked C1’s bottom while in the air. Other confidential interviews revealed that C1 was placed in time out by the entrance to the facility. Interview with S2 disclosed that C1 had fallen on the ground and S1 helped C1 up while cleaning off C1’s pants from wood chips. Other confidential interviews disclosed the children are placed in time out when disciplined. Records review reveal that corporal punishment and other humiliating, or frightening techniques are prohibited. Other records review disclosed that time out should not be used as a form of discipline. (contiued on next page)

Based on confidential interviews and records review the preponderance of evidence has been met and the allegation that staff inappropriately disciplined a child while in care is substantiated. The facility is being cited for title 22 section 101223 (a) (3) Personal Rights and 101173 (d) Plan of Operation Plan of Operationwhich poses an potential health and safety risk to children in care. This was not met as evidenced by record review and confidential interviews the children are being place in time out for at least a minute for each year of age when disciplined.

An exit interview was conducted, this report, appeal rights was explained and handed to Director, Chandani Jayasinghe.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00
