On December 9, 2025, at 9:05AM, Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced complaint inspection for the purpose of delivering findings regarding the above allegation. LPA met with Facility Representative, Nicole Lawhorn. During the inspection there were 33 children present with with seven staff members.

During the course of the investigation, interviews were conducted with the Facility Representative, staff members, daycare children, daycare parents and a outside agency. LPA reviewed and obtained copies of facility roster, personnel report, staff timecards, facility sign in/sign out sheets, related documentation and video footage. Staff and children’s records were reviewed.

It was alleged that staff restrained daycare child. Facility Representative and staff denied the allegation and stated that daycare children are never placed in any restraints.

Facility Representative and Staff 1 (S1) acknowledged that S1’s leg was placed over daycare in question during nap time while the child laid on a cot to mimic the comfort of a weighted blanket. S1 stated that her leg was placed on the bar on each side of the cot and not touching the child in question’s body. S1 stated that placing her leg over the cot was not an intentional restraint and there was no malice intended. LPA’s review of video footage determined that on October 10, 2025, and October 13, 2025, S1 placed her left leg over the legs of daycare child in question between the hours of 11:59AM and 12:01PM, while the child laid on a cot during nap time.

This is a repeat violation, facility was cited on June 11, 2025, Personal Right section 101223(a)(3). A $250 Civil Penalty was issued. Refer to LIC421FC.

Based on interviews conducted with the facility representative, staff members, an outside agency and LPA’s review of video footage the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 1), is being cited on the attached LIC 9099D.

LPA Vicky Williamson informed Facility Representative Nicole Lawhorn that this report dated December 9, 2025 documents (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Vicky Williamson informed the Facility Representative Nicole Lawhorn to provide a copy of this licensing report dated December 9, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Facility Representative, Nicole Lawhorn.

Facility Representative stated that she has discussed personal rights violation with all staff and conducts classroom observations often. Facility Representative stated that she will conduct a personal rights training with all staff and provide written procedure on how she will ensure that staff are not in violation

Based on observation, interview and record review, the licensee did not comply with the section cited above in that S1 violated the personal righs of child in question by placing her legs over the child during nap time which poses an immediate health, safety or personal rights risk to persons in care.

Facility Representative and staff stated that they would never hit any daycare children.

Facility Representative and staff members stated that some staff assist the children with relaxing on their cots during nap time by patting the backs of daycare children. Staff members stated that some staff pat the children’s back with a firmer pat than others; however, they are not hitting the children or being aggressive. Staff in question stated that she would never hit a daycare child and that when patting the backs of daycare children at nap time there is no harm intended. On November 4, 2025, LPA’s observation of staff members patting the children’s back during nap appeared to be firmer for some staff and lighter for other staff however, there was no intentional malice observed at the time of inspection.

LPA’s review of video footage for the period in question did not capture daycare children being hit by any staff. There were no disclosures from daycare children interviewed, that they were hit by staff in question or any staff members.



Based on interviews conducted, LPA’s observation, review of video footage, there were no disclosures that corroborated that staff hit daycare child. Due to conflicting interview statements, the allegation is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No deficiencies cited. A notice of site visit (LIC 9213) was given to Facility Representative, Nicole Lawhorn, and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Appeal Rights (LIC 9058) were provided.
