32 | Facility Representative and Staff 1 (S1) acknowledged that S1’s leg was placed over daycare in question during nap time while the child laid on a cot to mimic the comfort of a weighted blanket. S1 stated that her leg was placed on the bar on each side of the cot and not touching the child in question’s body. S1 stated that placing her leg over the cot was not an intentional restraint and there was no malice intended. LPA’s review of video footage determined that on October 10, 2025, and October 13, 2025, S1 placed her left leg over the legs of daycare child in question between the hours of 11:59AM and 12:01PM, while the child laid on a cot during nap time.
This is a repeat violation, facility was cited on June 11, 2025, Personal Right section 101223(a)(3). A $250 Civil Penalty was issued. Refer to LIC421FC.
Based on interviews conducted with the facility representative, staff members, an outside agency and LPA’s review of video footage the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter 1), is being cited on the attached LIC 9099D.
LPA Vicky Williamson informed Facility Representative Nicole Lawhorn that this report dated December 9, 2025 documents (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Vicky Williamson informed the Facility Representative Nicole Lawhorn to provide a copy of this licensing report dated December 9, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given to Facility Representative, Nicole Lawhorn and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. LPA observed LIC 9213 was posted. Appeal Rights (LIC 9058) was provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Facility Representative, Nicole Lawhorn. |
