32 | Staff interviews reveal that a staff member pulled the child out from under an isle in the classroom by both of their hands. Staff interviews stated after the incident, the child was able to use both of their arms during outdoor play therefore; staff did not infer an injury occurred to the child. One staff interview revealed the incident was not reported to the child's guardian because staff was not aware an injury occurred. The facility has conducted a staff training day on 06/19/2025.
Based on the information gathered during the investigation, the staff member may have caused an accidental injury to the child and was not aware to report it to the child's guardian in a timely manner. There were no disclosures that corroborate that staff were intentionally trying to injure the child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
A Notice of Site Visit (LIC 9213) was provided to the Licensee, Lynn Twork and advised must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Licensee was advised failure to comply with posting requirements shall result in an immediate civil penalty of $100.
An exit interview was conducted and the report was reviewed with the Licensee, Lynn Twork. |
