On August 29th, 2022 at 07:50 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted a case management inspection to inspect the bodies of water located on the same campus as the facility. LPA advised Director Cristina Jimenez of the inspection’s purpose and was granted facility entry.

The facility serves 20 children ages 6 weeks through 2 years in Classroom 5. The following ratio was observed in 1 classroom: ten (1) infants supervised by three (3) staff. Appropriate ratios were maintained, and visual observation noted. Staff present have required criminal background clearances. The daycare operations schedule is weekdays from 8 AM to 5 PM.

The facility is located within a locked, enclosed area of the Copley Price Family YMCA. This complex encompasses an entire city block. A parking structure is located on the campus’ northern end. City streets border the complex on all its four (4) sides. This compound was opened in 2015. This facility was licensed on 10/23/2020. Within this complex are two (2) pools and one (1) Jacuzzi spa. The exterior pool is fenced and locked with self-latching gates that swing away from the pool. The interior pool is enclosed in a glass structure. The Jacuzzi/spa is located next to the inside pool. The director and staff states that children do not use either pools or the Jacuzzi/spa.

The interior of the facility is located inside off the campus’ immediate southwestern street. The center’s locked lobby door separates the facility from the complex’s common hallway. Once inside the secured lobby, one enters the facility through a secondary locked door. The facility is located on the immediate left side upon entry into the complex from its southwestern street side. The director and assistant director have master keys to all facility doors and gate. Staff members and parents have the access code to the facility’s locked lobby door. A different code is used to enter the facility’s door towards the classrooms; only staff have this facility door code. LPA was unable to open the locked lobby and center doors without staff’s assistance. Director, staff and LPA toured the complex’s common hallways, outdoor pool area, indoor pool area and Splash Pad area.

The pools are located on the compound’s eastern side. Pool visitors walk past the locked facility area (located on the complex’s southwestern side) towards the front receptionist then turn northwards from the common hallway. Access into the interior pool is through the exterior hallway leading to the outdoor pool or from an interior door across from the locker rooms. A jacuzzi is adjacent to this indoor pool. This area is enclosed in a glass structure with an unobscured view. The enclosed inside pool faces out onto the outside fenced pool. A glass door allows access from the interior area out onto the outside pool.

Access to the outside pool is via an exterior hallway or by walking through the indoor pool area. The southern side of this outside pool faces onto the enclosed interior pool. The remaining sides of the outside pool are enclosed in a metal slatted fence, which measures at over 5 feet tall. This fence does not obscure the pools from view. The outside pool fence has gates with self-latching device,s which swing away from the pool. Individual I1 (I1) is the campus’ Aquatic Director, who oversees the complex’s bodies of water. (See LIC 811 Confidential Names).I1 informed LPA that whenever doors to either pools are open, certificated lifeguards are present in the pool areas. Director and LPA reviewed a sample of the lifeguards’ YMCA lifeguard certification course certificates/water safety certificates.

I1 stated that daycare infanta do not use either pools or the Jacuzzi/spa; lifeguards and pool staff do not supervise daycare infants. I1 said pools have operative pumps and filtering systems.

The facility’s outdoor play area is located on the western end of the campus. Next to the western end of the outside fenced pool is an exterior walkway; a concrete wall separates this exterior walkway from the facility’s outdoor play area on its eastern side. This wall is over ten (10) feet tall. The facility’s outdoor play area is fully fenced. A key-locked gate is in the northern end of the outdoor play area. This locked gate also has an alarm and an access code lock. During the height of the pandemic, parents delivered children through this back gate; after all children arrived, staff locked this back gate. Children are now dropped off through the facility’s lobby; the back gate is no longer used for drop offs. Director states that the key to the gate is in possession of both the director and assistant; staff must obtain this gate key by retrieving and returning this key to its secured storage area. LPA attempted to open this back gate but found it was locked.

Staff and director states infants do not use the Splash Pad area. The “Splash Pad” area is fully fenced and located on the complex’s northern end, behind the fenced outdoor pool area and in front of the parking structure.

Views into the “Splash Pad” are not obscured by its slatted fence.

Staff and Directorr state daycare infants do not use the "Splash Pad", outdoor pool, indoor pool or Jacuzzi/spa; futhermore, daycare infants do not have direct access to any bodies of water. Daycare infants cannot independently gain access to the common areas which leads to the pools, Jacuzzi/spa or “Splash Pad”. Daycare infants cannot leave the daycare areas without the aide of an adult due to the padlocked outdoor play area gate and facility’s dual locked doors from the center and lobby.

No deficiencies were issued during today's inspection.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Cristina Jimenez.
