On 11/142022 at 11:45 AM, Licensing Program Analyst (LPA), Diana Sanchez made an unannounced complaint inspection today to deliver the complaint investigation findings for the above allegations. LPA met with the Facility Assistant Director, Amber DeLuca and made her aware of the reason for today’s inspection. Current census is 8.

This agency has investigated the above listed allegations. During the course of the complaint investigation, LPA conducted interviews with the director, facility staff, daycare parents, and conducted facility tour. LPA reviewed the facility sanitation procedures and correspondence to parents.

It was alleged that staff were not properly sanitizing the facility. The facility staff denied the allegation, stating that staff sanitize all infant areas. Staff stated that they continually clean and sanitize the areas throughout the day, especially after diaper changes. According to staff, playground equipment, toys and work surfaces are wiped down after each use.

It was also alleged the facility allowed children exhibiting signs of illness to be present at the facility. Facility director denied the allegation, explaining that there was an increase of children ill with the flu during the month of September 2022; however, facility staff conducted daily inspections for illness at drop off and children with obvious symptoms of illness were not accepted. The facility director stated the facility reimplemented daily temperature checks before admitting children, in an effort to prevent a flu outbreak. The facility director stated that on September 26, 2022, a notice was sent to all parents advising them of the practice and facility continued doing temperature check for two consecutive weeks after the notice was sent out to parents. Parents interviewed did not disclose any concerns or issues with the facility or staff.

Based on the information obtained, LPA was unable to confirm whether or not staff is properly sanitizing the facility or that the facility was admitting sick children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview conducted and report was reviewed with assistant director, Amber DeLuca. A copy of this report, along with Appeal Rights (LIC9058 03/22), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
