On 8/8/24 at 11:30am, Licensing Program Analyst LPA Adrian Castellon conducted an unannounced inspection to deliver complaint findings for the allegations listed above. LPA met with
director Brenda Casillas to discuss the purpose of the inspection and toured the facility. Based on the interviews conducted and staff admissions, the allegations are substantiated. Child in care was left outside of classroom without staff knowledge for approximately thirty seconds to one minute. Incident was not reported as required to the licensing office. As such, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. One Type A citation is issued and one Type B citation issued. Exit interview was conducted, report reviewed, and Appeal Rights discussed with assistant director. LPA informed assistant director to provide a copy of this report that documents Type A citation to parents/guardians of children currently enrolled by the next business day or the next day children are in care, and to newly enrolled parents/guardians for 12 months from this date. LPA discussed LIC9224 process. Civil penalty of $500 also issued on this date.

On 8/8/24, at 11:30 AM, Licensing Program Analyst (LPA) Adrian Castellon conducted an unannounced complaint inspection to deliver the complaint investigation findings for the above allegation. LPA met with Director Brenda Casillas and discussed the purpose of today’s inspection.

This agency has investigated the above listed allegations. During the investigation, two unannounced facility inspections were conducted, interviews with facility staff and day-care parents were conducted, and ratio sheets and diaper logs were obtained. Children's interviews were attempted. There is insufficient evidence to support and no witnesses to corroborate the above allegations. Based on conflicting information, LPA was unable to determine whether or not, the above allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated. Exit interview conducted and report was reviewed with licensees. A copy of this report, along with Appeal Rights (LIC9058), were provided. A Notice of Site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
