On January 4th, 2023 at 8:15 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted an inspection to conclude the complaint investigation regarding the above allegation. LPA advised Director Tina Prowant of the meeting’s purpose and was granted facility entry. There were twelve (12) children (ages 2 - 3 1/2 years) in classroom 5 with three (3) teachers. There were seven (7) children (ages 3 - 5 years) in classroom 6 with one (1) teacher. There were eleven (11) children (ages 3 - 5 years) in classroom 7 with two (2) teachers.

The investigation involved facility tours, document reviews and observation of the facility camera videos. It also involved interviews with involved witnesses, children, daycare parents, staff and the director.

Staff provided documentation to the Department confirming the facility's exterior is treated for insects and rodents on a regular basis. Children report they have not observed rodents but observed the rodent droppings. Witnesses observed a deceased rodent on the classroom’s ceiling tile as it was removed by workmen.

Observation of the facility surveillance videos reveal a deceased rodent on a ceiling tile when the ceiling tile was removed by workmen.

Based on LPAs’ observations, conducted interviews and record reviews, the preponderance of evidence standard has been met, therefore the above allegation that facility staff did not ensure classroom was kept in a sanitary condition for children in care is found to be SUBSTANTIATED, California Code of Regulations, (Title 22, Division 12 Chapter 3) are being cited on the attached LIC 9099D.)

LPA provided Director Prowant with a hard copy of CCR Title 22 Section 101238(a)(1) “Buildings and Grounds”. Director and LPA reviewed this regulation together. A copy of this report, notice of site visit (LIC 9213), and appeal rights (LIC 9058) was provided to Director Prowant.

A notice of site visit was given and must remain posted for 30 days. LPA observed the notice posted. An exit interview was conducted, and report was reviewed with Director Tina Prowant. This report and a copy of their appeal rights (LIC 9058) was provided to Director Tina Prowant.

Director states the facility will continue with the monthly pest services maintenance. Director states the facility will maintain a cleaning protocol of daily cleaning and also deep cleaning. LPA reviewed the Building and Grounds regulations with the Director.

Based on conducted interviews, record reviews and observation of the facility surveillance video, the Licensee failed to ensure the center was free of rodents, which poses as a potential risk to children in care.
