On 12/01/2022 at 02:01pm, Licensing Program Analyst (LPAs) David Miller and Vicky Williamson conducted an inspection to conclude the complaint investigation regarding the above allegation. LPA advised Director Jacquelyn Aguigui-Fajardo of the meeting’s purpose. There were ten (10) children and two (2) staff.

During the course of the investigation, interviews were conducted with complainant, Director, staff members, daycare chidlren and parents. Based on records review on 10/10/2022 and interviews it was determined that none of the staff had current CPR and First Aid certification as they had already expired when the complaint was reported on 10/04/2022. The preponderance of evidence standard has been met. The above allegation is found to be SUBSTANTIATED, California Code of Regulations, (Title 22, Division 12 Chapter 1) is being cited on the attached LIC 9099D.

The Notice of Site Visit (LIC 9213) and Appeals Rights (LIC 9058) were provided. LPA observed the LIC9213 posted by the front door An exit interview was conducted with the Director, Jacquelyn Aguigui-Fajardo.

Director stated that all staff renewed their CPR and first aid certification on 10/21/2022. Director stated that she will submit a written plan verifying that she has a plan in place to ensure staff maintain certification. Director stated that she will submit this plan by 12/09/2022.

Based on interviews and record review, licensee did not comply with the above regulation as none of the staff had a current CPR and pediatric first aid which poses a potential health and safety risk to persons in care.

LPA advised Director Jacquelyn Aguigui-Fajardo of the meeting’s purpose. There were ten (10) children with two (2) teacher.

During the course of the investigation, interviews were conducted with complainant, Director, staff members, daycare chidlren and parents. Staff members stated that they observed one bug when the facility was closed during cleaning between Summer and Fall sessions. Staff stated that children have their own mats, and if they roll off, staff will place them back on the mat. Staff stated that they ensure children safely walk across the crosswalk when they walk children to and from the playgroud. Staff stated that all children are always being supervised. Conflicting information was obtained during the investigation. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are unsubstantiated. No deficiencies cited.
