On 3/29/2024, at approximately 8:50AM, Licensing Program Analyst (LPA) Jonathan Tse conducted an unannounced annual and case management visit regarding an increase in capacity at the facility. LPA met with Campus Director Christophe Cailton (D2) and Assistant Director Sylvie Johnson (D3). Director Christophe de Renty (D1) arrived at 10:00AM. LPA explained the purpose of the visit. Present during the visit were 11 teachers and 75 preschool age children.

LPA inspected the facility for any health or safety hazards. The facility currently operates in rooms 117, 123, 124, 125 and 111. Rooms 115 and 116 are currently not being used by the preschool. LPA observed at least two staff members present in each classroom. LPA observed fully charged 2A10BC fire extinguishers to be present in or directly outside each classroom. There are carbon monoxide and smoke detectors present in the facility. All electrical outlets were observed to be covered or obstructed by furniture when not in use to be inaccessible to children. All poisons, cleaning detergents, and other chemicals are stored inaccessible to children.

LPA observed age-appropriate toys and learning materials to be present. There are cots available for napping that are labeled with each child’s name. Bedding is brought from home and taken back once a week to be cleaned. There are cubbies for each child outside each classroom. Per D3, children are signed in via the Brightwheel app. Parents may sign in children at the entrance of the facility or walk them to their classrooms before signing them in. There are allergy lists posted in each classroom, in addition to medical directions. LPA observed all classrooms to be equipped with first aid kits. Medication is stored in a high cabinet and inaccessible to children in care. Evacuation maps and routes are posted in each classroom. Children’s furniture is age-appropriate and has rounded edges. Water bottles are brought from home and refilled at a refilling station. Children have the option of bringing their own lunch or eating lunch provided by a third-party vendor.

During inspection of Room 125 at approximately 9:45AM, LPA observed that a staff member, S4, was not present on the facility’s Guardian roster. During record review of the facility at approximately 12:00PM, LPA confirmed that S4 did have a criminal background clearance but was not associated to the facility. LPA discussed criminal background clearance transfers with D1. Per D1, S4 was a substitute for the primary school and was assumed to have had a criminal background clearance. LPA informed D1 that a Type A deficiency will be issued and a civil penalty of $100 will be assessed today. D1 stated that they understood.

LPA conducted measurements of Rooms 115 and 116. These rooms were previously approved and added to the facility license during a tele-visit on 9/9/2020. There was no increase in capacity at the time. The facility submitted an application for an increase of capacity on 3/11/2024. LPA inspected both rooms for health and safety hazards. Room 115 was measured at 482.3 sq. ft., allowing for a capacity of 13 children. Room 116 was measured at 553.6 sq. ft., allowing for a capacity of 15 children. Total allowable square footage equals 1035.9 sq. ft., allowing for a capacity of 28 children based on measurements for each classroom.

LPA discussed outdoor activity space requirements with D1. The current outdoor activity space is currently approved for use by up to 103 children. LPA discussed rotational waiver requests for use of the outdoor space with D1, in the case that the facility is approved for more than 103 children.

LPA reviewed personnel files, children’s files, and facility records. LPA observed that there is at least one staff member present with First Aid/CPR certification. All staff members have completed Mandated Reporter Training. See LIC9102-TA for technical assistance provided regarding Mandated Reporter Training and First Aid/CPR certification. LPA observed all children’s files to be complete. All required postings are posted and accessible for review outside of Room 124. Emergency drills are conducted and properly logged.

LPA reviewed the facility’s lead testing records and found that the facility initially tested for lead on 8/30/2023, past the deadline of 1/1/2023. The facility had tested all required fixtures and did not have any exceedances of lead (above 5.4 parts per billion). LPA discussed the lead testing requirements and Written Directives regarding lead with D1. LPA informed D1 that a Type B deficiency will be cited and cleared on the same day of the visit, 3/29/2024. D1 stated that they understood.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a
maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

LPA referred facility representative to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

The facility's application for capacity increase shall be approved for up to 28 additional children, pending receipt of fire clearance and department review.

Appeal rights were provided and explained to D1. A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with facility representative, Christophe de Renty. A physical and digital copy of the report shall be provided to the facility on this day.

LPA Tse informed facility representative Christophe de Renty that this report dated 3/29/2024 documents one Type A citation which shall be posted for 30 consecutive days as there was immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Tse informed the facility representative to provide a copy of this licensing report dated 3/29/2024 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
