On July 26, 2022, Licensing Program Analysts (LPAs) Van and Garcia conducted an initial complaint investigation received on 7/18/2022. Based on the information received, LPAs conducted surveillance at Noe Valley Court Park. LPA arrived at the Noe Valley Court Park at 10:30 am. At approximately 10:40 am, LPAs observed a group of 6 teachers and 21 children arrive at the park. The teachers and children utilized the tennis court during the observation. At 11:20 am, LPAs went to the teachers and introduced and the teachers confirmed that they are from Noe Valley Kids. LPAs then informed teachers of the purpose of a complaint investigation and confirmed the number of children present at the park with the teachers.

Based on LPAs observations and interviews, which were conducted, the preponderance of evidence standard has been met. Therefore, the above-listed allegation is found to be substantiated.

The facility must adhere to her outdoor waiver limitations and requirements. The facility owner states she will reduce the number of children outdoor and provide Licensing with a written plan/schedule to comply with the outdoor facility waiver by August 1, 2022. A written plan and schedule will be sent to LPAs.

Based on observation and interview, the facility did not comply with the Departmental-issued outdoor waiver, a ratio of one teacher to two children in a public park. LPAs observed 21 children and only 6 teachers. The facility did not adhere to the waiver, which poses potential health, safety, or personal rights risk to children in care
