25 | On 06/15/2023, at 2:05 PM Licensing Program Analyst (LPA) Francisca Velazquez conducted an unannounced Case Management Legal/Non compliance inspection to deliver Decision and Order- CDSS No. 6423023101 in the matter of Juan Asipuro-Nolasco aka Juan Aispuronolasco. LPA met with Licensee, Erika Aispuro and explained the purpose of the inspection. LPA notes five children are in care at the time of the inspection.
The Decision and Order details the exclusion of Juan Aispuro-Nolasco aka Juan Aispuronolasco ordered 06/12/2023, effective 06/22/2023. The Decision and Order notes Juan Aispuro-Nolasco aka Juan Aispuronolasco has failed to file a Notice of Defense, has thereby waived the right to a hearing to contest the merits of the pleading, and that as a result, Respondent is in default. Further, Decision and Order details, Juan Aispuro-Nolasco aka Juan Aispuronolasco is prohibited from employment in, presence in, and contact with clients of, any facility licensed by the Department, certified by a licensed foster family agency, or any resource family home, and from holding the position of member of the board of directors, executive director, or officer of the licensee of any facility licensed by the Department, for the remainder of Respondent’s life. The Licensee was provided a copy of the Decision and Order.
LPA, toured the facility in the company of the Licensee. LPA did not observe Juan Aispuro-Nolasco aka Juan Aispuronolasco on site. Licensee indicated Juan Aispuro-Nolasco aka Juan Aispuronolasco has not lived in the Family Child Care Home since August 2022 and Licensee has no contact with Juan Aispuro-Nolasco aka Juan Aispuronolasco. LPA notes that Respondent is licensee's ex-spouse. Licensee understands that Respondent can not be in the facility for any reason at all. LPA explained the importance of following this decision and order.
No deficiency was cited today. A Notice of Site Visit (LIC 9213) was issued and must be posted for 30 days or a civil penalty may apply. Appeal Right (LIC 9058) were given.
Exit interview was conducted and report was reviewed with Licensee, Erika Aispuro in Spanish due to Spanish being licensee's primary language.
