On 3/11/25, at 10:55 AM, Licensing Program Analyst (LPA) Shane Loftus conducted an unannounced Annual/Random Inspection of the above-mentioned Child Care Center (CCC). LPA met with Site Supervisor Bryan Mendoza and Administrator Kimberley Love, and explained the nature of the inspection. LPA, in the company of the Site Supervisor, toured the interior and exterior of the CCC. LPA notes 19 children are on site during the inspection, along with seven teachers (cleared and associated) providing care and supervision. The CCC is on the grounds of the Mindbody Headquarters. The Infant program consist of three rooms. The CCC has a preschool program on site which operates under a separate license (406216227). The CCC operates from 7:45 AM-5:15 PM Monday - Friday.

LPA observed the rooms used for child care to be clean, organized and free of toxins. Each room is equipped with age-appropriate furniture and toys. Cribs and cots are available for children in care. LPA observed changing stations within arm's reach of the sinks. The rooms also have mini refrigerators to store food items for infants. Food items for the children's consumption are labeled and dated. Parents of children in care provide the children meals and snacks. The CCC also has snacks and meals available if needed. The CCC provides filtered water for the children inside the CCC and in the outside play area.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

There is ample storage space observed in the classroom for all children. LPA observed carbon monoxide detectors throughout the CCC. At 11:10 AM, a carbon monoxide detector was tested and found to be operable. There are two separate restrooms available to children, if needed. The restrooms are in safe and sanitary operating condition. Each room has a parent board containing required licensing notices and documentation. Administrator informed LPA no firearms or ammunition is stored on the premises.

The outdoor play area is completely enclosed by wrought iron fencing and the footing is varied. LPA observes play structures in the outdoor play area to be age appropriate and free of hazards and sharp points. The fall zones around the play structures have appropriate cushioning in the form of rubber matting. LPA observed ample shade in the outdoor play area which is provided by trees and shade sails. LPA notes the CCC has a Waiver from the Department for the staggered use of the outdoor playground area. LPA observed no bodies of water on site. Administrator was reminded to replace toys and play equipment which is degraded or is not in good repair.

The CCC electronically signs children in and out of the CCC. LPA reviewed the Sign In/Out system printouts which contain the arrival and departure times of children as well as electronic signatures of authorized representatives.

A sampling of staff and children's records were reviewed. The children’s records were complete and found to contain emergency contact information as well as immunization records. Records also included log documenting 15-minute sleep checks. LPA reviewed Individual Sleep plans which were completed appropriately. Staff records were reviewed and are current with Pediatric First Aid/CPR (EMSA Approved) and Mandated Reporter Training certifications, as well as documentation supporting qualifications and experience.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Facility Representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an or additional resource. LPA also informed Facility Representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

No deficiencies were cited during today’s visit. A Notice of Site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility Representative, Kimberley Love.
