On February 22, 2024, at approximately 9:10 AM., Licensing Program Analyst (LPAs) Gil, and Olguin-Leon arrived at the Challenge School to conduct an unannounced, annual inspection. LPAs met with Director, Hanan Geith, and explained the purpose of the inspection. Present in the facility are the Director, 14 staff, and 72 children in care. All present staff have criminal record clearance. Classroom number one is operating over capacity.

The program is open M-F, 08:30 AM to 5:30 PM. Program operates in a two floor building with 3 classrooms on the lower level. The second floor is a separate program for after school. A toddler option is available. The facility is equipped with four children’s restrooms with multiple working sinks and working toilets. Sinks have no hot running water. Staff restroom is separated. Per director, smoking is prohibited, and there are no firearms or weapons located in the facility.

LPAs observed classrooms to be clean and equipped with age-appropriate toys and materials. Storage for children's belongings is located inside the classrooms, labeled with each child's individual name. LPAs observed facility has an installation of a fire alarm system inside each classroom as well as a fully charged, fire extinguishers located in the Butterfly/Ladybug room. Each classroom has labeled cots for each child as well as their own blanket separately stored in their cubbies for nap time. Each classroom has an available emergency first aid kit. There are multiple children enrolled with prescribed medication epi-pens. The facility stores medication inside the classroom inaccessible to enrolled children and maintained with proper documentation. All prescribed medication is kept in original packaging.

All poisons, cleaning solutions and hazardous materials are stored inaccessible to children in off limit areas to children. The facility offers snack. Lunch is catered daily. Menus are posted in the entrance of the facility visible to parents, as well as in each classroom. Water is available to children indoors and outdoors. Per director, children bring their own water bottles and refill them with facilities available filtered water.

All outdoor area is clean and orderly. LPAs observed openings in foams under playground for the Lady Bug classroom. LPA advised facility to fix openings on the playground foam to ensure child safety outdoors. Per director, facility is aware and in process of fixing this. LPAs also observed one sandbox outdoor with no cover. LPAs advised director to purchase cover. LPAs also observed outdoor shaded areas. There is a variety of outdoor equipment that is in good working condition. Children are signed in and out of the facility with parents' signatures through Bright Wheel. The facility has license documentation and information properly posted and available for review at the entrance. There are no pools or bodies of water on the promises.

LPAs reviewed facility records that included 5 children's records and 5 staff records. LPAs observed children's records to be complete. There was at least one staff member who has an up-to-date CPR & First Aid certificate. LPAs observed that staff records were missing documentation and need to be complete. One staff is missing her Mandated Reporter Training(S2). Director was reminded that these documents need to be in staff file available to the department. Per director she will complete this training later today. The last emergency drill was conducted on 1/26/2024. Emergency drills are conducted at least once every six months and are properly logged and documented.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Facility was informed that as of September 1, 2016, a person may not be employed or volunteer at a childcare facility unless he or she has been immunized against influenza, pertussis, and measles or qualifies for an exemption pursuant to Health and Safety code 1596.7995 and 1597.662.

The Director is aware that all staff is required to complete Mandated Reporter Training every two years. The training can be obtained online at www.mandatedreporterca.com. LPA observed the completion certificate on al files except one(S2). LPAs encourages the director to frequently visit our website at www.ccld.ca.gov for licensing regulations and new updates.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on observation, the licensee did not comply with the section cited above. There were 25 children in a classroom that can only accomidate 13 kids, which poses an immediate health, safety or personal rights risk to persons in care. Per measurements of classrrom, the square footage 461.21 sq ft divided by 35 equals 13 children in classroom 1(Big Catapiller room). Classroom 4 (Small Caterpiller room) accomidates 7. LPAs observed Room 1 (combined caterpillar rooms) to be over capacity.

Per Director, she will move and seperate toddlers between Classroom 1 and 4. 7 toddlers will be placed in Room 4, 13 toddlers will be placed in Room 1. The 2 remaining children( and other three year olds) will be moved to the Lady bug classroom.

LPAs Janet Gil and Maria Olguin-Leon informed director Hanan Geith that this report dated 2/22/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPAs Janet Gil and Maria Olguin-Leon informed the director to provide a copy of this licensing report dated 2/22/2024 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
