25 | On April 12, 2024, Licensing Program Analyst (LPA) Kassandra Medrano conducted a case management inspection. Upon arrival, LPA observed Yunhan "Rachel" Shen receiving a child from their parent through the front door of the facility. Rachel is the licensee of another facility (4140004119) and has criminal record clearance but is not associated to this facility. During the inspection it was found that facility was using a space that was marked as an off limits area. During inspection on 4/3/2024, LPA spoke to Michael about adding space to license but he stated that he did not feel the area was space was safe for children. Today during inspection it was observed that the cement space behind yard was set up for play. Based on interviews with staff the facility is using the space for play as the yard that has been approved in muddy. During visit, toys were moved into yard, and licensee stated that they will not be using that space. Licensee and facility representative were reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
LICENSEE MUST POST ANY TYPE A DEFICIENCIES DURING TODAYS VISIT WITH THE NOTICE AND LICENSEE UNDERSTANDS THE NOTICE AND TYPE A DEFICIENCIES MUST REMAIN POSTED FOR THIRTY DAYS. REQUIREMENTS FOR AB 633 FACT SHEET AND A COPY OF ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC 9224) WERE DISCUSSED WITH APPLICANT/PROVIDER. PROVIDER UNDERSTANDS THIS REQUIREMENT.
