On July 11, 2024 at 9:05 AM, Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced Required- 3 Year inspection. LPA met with licensee Maria Lourdes Gastelum and advised the purpose of the inspection. Licensee provided LPA a tour of the home inside and out. At the time of inspection there were six children in care of 2 fingerprint cleared adults. Licensee's 14 year old nephew was also in the home, no other adults were observed in the home. Hours of operation are M-F 7:30 AM- 5 PM.

LPA observed required Licensing required documents posted prominently at the entrance. Children in care have access to living-room, one restroom, kitchen, dining room and enclosed front yard. Bathroom was observed to be clean and free of toxins/hazardous items. Kitchen knives were observed to be located in an inaccessible top shelf. Children have access to toys that are age-appropriate inside and outside of the home. Front yard play area is enclosed and has plenty of bicycles, scooters, and activities. There are no bodies of water present at the time of inspection. During the tour, LPA did not observe any hazards/toxins items accessible to children in care.

Fire and earthquake drills are being documented every six months. Last drill was conducted on 6/10/2024. Fire extinguisher 3A10BC was observed in the kitchen with a receipt showing a purchase date of 3/29/24. Fire and carbon monoxide detectors were observed throughout the home. Detectors were not tested as infant child was asleep. Licensee certifies they check the batteries regularly to ensure they are in working condition.

LPA reviewed six out of six children files. All children files were current. Licensee CPR/first aid is valid through 4/03/2026. Licensee was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com Licensee’s mandated reporter certification is valid through 12/07/2025.

Based on observation and interview, the licensee did not comply with the section cited above as an infant was found sleeping in a bassinet which posed a potential health, safety or personal rights risk to persons in care. Bassinet is a Ingenuity Foldaway Rocking Bassinet.

LPA provided a copy of the Safe Sleep Frequently Asked Questions (FAQs) in Spanish. Licensee agrees to submit a written statement on what she learned from the FAQs and how she plans to prevent this from reoccurring. Licensee must submit proof of new crib/ play pen. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA observed a safe sleep log being documented for infants in care every 15 minutes. LPA observed an infant sleeping in a bassinet located in the dining room area. LPA advised Licensee that bassinets are not allowed in the home.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. During the inspection LPA observed child's medication to be located in a tote bag in an area that is accessible to children. Licensee stated that the bag had been taken out for a couple minutes. Given the fact that the medication was located at the bottom of the tote bag and hard to reach, LPA determined there was no immediate risk. LPA reminded Licensee to ensure that medication is stored in area that is inaccessible to children and to also check for expiration dates.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE Maria Lourdes Gastelum, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

During today's inspection one Type B deficiency is being issued for using a bassinet for sleep. Deficiency can be found on the attached 809-D.

LPA provided a copy of Safe Sleep Frequently Asked Questions in Spanish and highlighted page 10 indicating bassinets cannot be used in the FCCH.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
