Licensing Program Analyst (LPA) Melanie Otsuji arrived to the facility unannounced to conduct an initial investigation into the above allegation. LPA was met by Director Morena Waack. Present during today's visit were 8 additional staff members and 54 preschool aged children.

During the course of the investigation LPA made observations, and conducted interviews. On approxmately, January 7, 2025 the school experienced a gas leak that caused the furnace to stop working. The facility was inspected by PGE and Director was informed that it was safe for children and staff to remain on site, however the gas to two wings of the preschool and elementary school are shut off and without central heating. The classrooms within the preschool classrooms are equipped with portable heaters until the gas furnace is repaired. During the physical plant tour, LPA observed Room 17's thermastat to be at 65 degrees Farenheit. Per Regulation, the temperature of any room that occupies children must remain between 68 degrees Fareheit and 85 degrees Farenheit.

Based on the LPAs observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division & Chapter Number 101223), are being cited on the attached LIC 9099D.

An exit interview was conducted and the report was discussed with Director, Morena Waack.

Director is to draft a plan on how Director will ensure that classrooms are within the appropriate temperature range prior to children's arrival. In addition to drafted plan, an HVAC/plumbing proposal to be submitted to LPA along with timeframe for repair of furance. All items due no later than 2/4/2025 via email.

This requirement is not being met as evidence by: During physical plant walkthrough it was observed that classroom 17 had a temperature of 65 degrees Farenheit. This poses a potential health & safety risk to children in care.
