On Wednesday, June 7, 2023 at 9:30 AM, Licensing Program Analyst (LPA) Manel Estoesta conducted an unannounced 10 day Initial Complaint Investigation Visit. LPA met with the Director Sushma Shrestha and the Licensee Nikki Yelam, explained the nature of the investigation and finding was delivered on this visit. Present on this visit were 7 staff and 46 preschool children. The facility operates from Monday to Friday 8am to 5:30 pm.

LPA conducted a Case Management Incident visit on May 26, 2023. The incident was reported by the Director on May 24, 2023 at 4 pm. The reported incident was related to the allegation above. The Unusual Incident reported was about C1 was found by P1, outside at the sidewalk of the parking lot adjacent from the outdoor play area exit door without supervision of a teacher on Tuesday, May 23, 2023, at 4:26 pm. P1 brought in C1 through the facility front door and reported the incident to the Director.

Continuation.

Based on LPA Estoesta Staff Interview, that C1 was playing at the outdoor play area and exited the outdoor play area exit door without a supervision S1 on May 24, 2023 approximately at 4:26 to 4:30 pm. In addition, the outdoor play area exits door's alarm system was malfunctioning and did not alarm when C1 opened and exited the door. The facility was in violation of Section 101229 (a)(1) that no child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time, except as specified in sections 101216.2 (e)(1) and 101230 (c)(1).

Based on LPA Estoesta's interviews which were conducted, and records reviewed, the preponderance of evidence standard has been met, therefore the above allegation is to be SUBSTANTIATED.

As a result the Case Management Incident visit on May 26, 2023, LPA cited the Licensee a Type A with immediate civil penalty and dicussed Acknowledgement of Receipt of Licensing Report (LIC 9224) requirement, no deficiencies cited on this visit.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Licensee Nikki Yelam and Director Sushma Shrestha.
