32 | On 06/11/2024, LPA Yangcheng Huang conducted a 10-day complaint visit at the facility and obtained copies of facility documents. On 07/11/2024, LPA Yangcheng Huang visited the facility again, interviewed staff and obtained pertinent files.
During IB’s investigation, IB reviewed all documents and videos received, including medical records, San Jose Police Department Report, Children’s Roster, Children’s Attendence Sheet, Staff Roster, Preschool Daily Program Schedule, Unusual Incident Injury, two videos from directors of C1 disclosing how C1 was injured. Additionally, IB conducted interviews with the reporting party, the director, teachers, daycare children, and daycare parents.
Based on the interviews and evidence gathered, it was determined that C1 sustained a fracture. However, there is insufficient evidence to conclude that the fracture resulted from staff's lack of supervision or that it even occurred while C1 was in care. Regarding the retaliation allegation, all staff interviewed stated that they did not observe any inadequate treatment, punishment, or mental/physical abuse of children by any staff member, including the director. They also stated that they were not instructed by the director or other staff to treat the children differently. Additionally, based on the staff interviews, there is insufficient evidence to determine that C2's scratch was caused by staff's lack of supervision.
Although the three allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
No deficiencies were cited. Exit interview was conducted, where the report was reviewed and discussed with director, Jian Deng in Mandarin. A NOTICE OF SITE VISIT WAS ISSUED AND MUST REMAIN POSTED FOR 30 DAYS. |
