On 05/10/2021 at 10:00 am, Licensing Program Analyst (LPA) Manel Estoesta conducted an announced pre-licensing inspection. LPA met with the applicant, Rhythm Nijhawan. The applicant has submitted an application for a small family child care home license. The facility address is 2136 Mesa Drive, Milpitas CA 95035. Present on this visit were the applicant's spouse Kamal Nijhawan and the applicant's two (2) school age children. The home was virtually toured to conduct a health and safety inspection. Applicant stated that the hours of operation will be from Monday to Friday 8:30 am to 5:00 pm.

The home is a single story home. The applicant owns the home since November 2020. Applicant provided Property Tax Bill dated 01/11/2021. The home is neat, clean with heating, ventilation for safety and comfort. The On-Limit areas are the Preschool room, the hallway bathroom and fenced backyard. LPA reminded applicant that other than wipes or things used for the children in the on limits children’s bathroom, they need to be empty of most all items (or locked up) cleaning products. The applicant understood. There are no accessible hazardous cleaning chemicals or other liquids in the on-limits area. The Off-Limit areas are the kitchen and dining room, two (2) bedroom, master bedroom and master bathroom, the living room, garage, front yard and the side yards which will be inaccessible to children in care by closed and or locked doors and or a fence with visual supervision.

LPA reminded the applicant that any structural changes to the home or additions to the child care facility must be reported to Community Care Licensing. The applicant understood.



Applicant has a first aid kit and plastic outlet covers on all electrical outlets in the on-limit areas. Applicant stated that there are no firearms in the home.

Applicant has ample age-appropriate toys and learning materials. The home has a fully charged 3A40BC fire extinguisher, combination smoke and carbon monoxide detectors (tested and functioning) and a working telephone.

LPA Estoesta incorporated Rapid Assistance Support Team (RAST) technical assistance due to the Coronavirus Disease 2019 (COVID-19) Public Health Emergency on this visit. Applicant completed the self-assessment document and sent a copy to LPA. LPA provided to the applicant the following links for reference;

At 11:00 am, LPA observed that the off limits side yards were not fenced or barricaded. LPA required the applicant to install a gate and or fenced on separating the on limit backyard from the off limit side yards. Applicants will install the barricade or fence by the end of the day and will send photos to LPA.

License is not granted at this time. Licensee will complete the requirement within 2 weeks. LPA discussed LIC 809, Appeal Rights and Notice of Site Visit. Exit interview conducted.

The applicant’s Health and Safety training is completed on 03/27/2021 that includes the Lead Prevention Training. Applicant's pediatric CPR and First Aid certificate is current and expires 09/2021. The applicant completed the California Child Abuse Mandated Reporter Online Training for Child Care Providers (AB1207) on 01/26/2021. LPA reminded the applicant that Mandated Reporter training and pediatric CPR/First Aid is to be renewed every one or two years. The applicant is in compliance with the immunization laws which pertains to day care providers.

Baby bouncers & drop-down cribs are not allowed at the day-care facility. LPA discussed Unusual Incidents Reports. There is no fireplace in the home. Ratios were discussed and provided a copy to applicant as a reminder.

Applicant is reminded that ALL assistants, volunteers, frequent visitors, or adults living in the home, that are 18 years of age or older must be fingerprint cleared and associated to this facility prior to being in the presence of children in care or an immediate civil penalty will be assessed from $100 to $3000 per person, per incident. Applicant was reminded of the responsibility as a mandated reporter. All forms can be downloaded at www.ccld.ca.gov



Incidental Medical Services (IMS) policy was discussed. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department.
