On 4/24/24 at 1:15pm, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with director, Lisa O’Neal. It was alleged that staff did not change infants diapers as needed and staff did not ensure infants were appropriately fed.

The director was interviewed on 2/29/24 at 2:15pm and denied the allegation. The director stated that she monitors the infant room throughout the day and has not observed anything to cause her to be concerned. Seven staff (S1, S2, S3, S5, S6, S7 and S8) were intrviewed on 2/29, 4/12, and 4/17. Five staff stated they do not have concerns about staff changing infants diapers when needed or staff feeding infants appropriately. S3 noted there have been times that staff change infants but get busy and do not have time to update the changing log or bottle log. S5 stated in February or March the bottle log indicated one infant (Child 1) went a significant amount of time without a bottle. S5 added that Child 1 appeared hungry because they attempted to suck on a zipper of a jacket.

On 2/29/24 and 04/24/24, LPA toured the facility and photographed a white board that documents when each infant received food and/or a bottle. LPA also photographed a daily changing log that appeared updated. During both inspections, LPA observed infants in care appear content.

Two parents (P1-P2) were interviewed on 4/11/24 and stated they have not had any concerns about staff changing infants’ diaper when needed or staff feeding infants throughout the day.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.

Exit interview conducted and report was reviewed with the director, Lisa O’Neal. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were provided.

On 4/24/24 at 1:15pm, Licensing Program Analyst (LPA) Nicolette Cunningham conducted an unannounced complaint inspection, and met with director, Lisa O’Neal. It was also alleged that staff inappropriately handled infants in care; specifically, Staff 3 picks infants up by their upper arms.

The director was interviewed on 2/29/24 at 2:15pm and denied the allegation. The director stated that she monitors the infant room throughout the day and has not observed anything to cause her to be concerned. Eight staff (S1, S2, S3, S4 S5, S6, S7 and S8) were interviewed on 2/29, 4/12, 4/17 and 4/24/24. S5 and S6 reported observing S3 pick up infants by their outer arm which caused the infants to cry. S5 reported S3 has incorrectly lifted C1, C2 and C3 by gripping the infant by their upper arm. S6 reported S3 placed her hand on C4, C5 and C6 chin in a firm manner to get the child to look at her. S5 reported S6 reported C4 repeatedly said “let go.” Staff 3 denied handling infants in a rough or inappropriate manner. Three children were interviewed on 4/24/24 and described S3 as nice. LPA attempted to interview C4. Two parents (P1-P2) were interviewed on 4/11/24 and stated they have not observed staff handle infants in a rough manner.

The director stated she moved staff around so that S3 is no longer working with infants under 12 months. The director will provide a training on how to appropriately handle a child.
The director will send proof of the training to LPA Cunningham by 5/1/24.

This requirement was not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above in one staff (S3) handled infants inappropriately which poses a potential health, safety or personal rights risk to children in care.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
