On May 25, 2023 at 9:00 am, Licensing Program Analyst (LPA) N. Cunningham conducted an unannounced complaint inspection, and met with Director, O’Neal. It was alleged that facility staff handled child in a rough manner, specifically, Staff 1 pulled Child 2 by the hoodie they were wearing which lifted the child off the ground. It was also alleged that facility staff did not assist Child 1 with toileting as needed which required the child to seek medical treatment. The third allegation is that facility staff did not provide visual supervision to children at all times; specifically, Staff 1 has been observed looking at their phone instead of supervising children.

The licensee was interviewed on 2/15/23 at 1:30pm and stated that due to a recent incident they made a few changes to the staff schedules. During the investigation (2/13/23 – 5/24/23) the licensee, director, five staff (Staff 1-3, 5 and 7), one parent (Adult 1), and one child (Child 1) were interviewed. Interviews revealed that two witnesses observed Staff 1 pull Child 1 by their hoodie which caused their feet to lift off the floor. Interviews also revealed that Staff 1 did not always assist children with toileting needs and Staff 1 often did not provide constant visual supervision because they were looking at their phone.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

LPA Cunningham informed director, O’Neal that this report dated 5/25/23 documents three Type A citations. Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.


Also, LPA Cunningham informed the director to provide a copy of this licensing report dated 5/25/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the director.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature. Based on interviews, Staff 1 did not comply with the section cited above with two out of ten children which poses an immediate health, safety or personal rights risk to children in care.

An unannounced complaint investigation inspection was made to the facility by Licensing Program Analyst (LPA), N. Cunningham. It has been alleged Child 1 sustained injuries in care due to staff neglect; specifically, a child fell and hit their head on a curb on the playground. It was also alleged that facility staff did not meet child’s need for wearing a jacket outside. The director was interviewed on 2/13/23 and 3/2/23 and stated they reported the incident the day the injury occurred. The licensee and director denied the allegations.

During the investigation (2/13/23 – 5/24/23) the licensee, director, five staff (Staff 1-3, 5 and 7), one parent (Adult 1), and one child (Child 1) were interviewed. Interviews did not corroborate the allegations. On 1/30/23, the director reported the injury as required and noted that Staff 5 and Staff 7 were supervising the children outside when Child 1 fell on the curb and hit their head. Interviews also reveal that staff do not require children to wear a jacket if the child does not want to.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. This report was reviewed and discussed with Director O’Neal. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days.
