Hazardous trees on property

On 10/12/2023 at 3:30pm, a closing complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) N. Cunningham. It has been alleged the trees on the property are hazardous.

On 9/14/23, LPA visited the facility and spoke with the director about the allegation. The director stated she was not sure if the trees on the property are safe or hazardous. The director also stated she was not aware if a tree expert inspected the trees on the property after a large tree fell in December 2022. On 9/19/23, the licensee e-mailed and stated a maintenance worker (MW1) from a tree company visited the facility and inspected the trees. On 10/3/23, the licensee forwarded an e-mail from MW1 stating, one hazardous tree and all the hazardous limbs have been removed and hauled off.

Based on MW1 statements, the preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

LPA Cunningham informed licensee to provide a copy of this licensing report dated 10/12/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the licensee. A notice of site visit was given and must remain posted for 30 days. Appeal rights were provided. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
