32 | One staff (S1) was interviewed on 8/26/25 and confirmed the allegation stating that S1 did grab C1 by the arm harder than S1 probably should have and when S1 picked C1 up by the arm C1 picked up their legs so S1 set down C1 and that C1 did cry after being set down. S1 confirmed that S1 called C1 dumb because child C1 had called S1 dumb first.
LPA Sims obtained copies of the facility's preschool roster, personnel report, and copy of S1’s write up.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
LPA Sims informed Director Lisa O’neal that this report dated 8/26/25 documents one Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Sims informed the Director Lisa O’Neal to provide a copy of this licensing report dated 8/26/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
During today’s inspection, the facility was toured and LPA Sims observed 15 children in care.
Exit interview conducted and report was reviewed with the Director Lisa O’Neal. Appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
