32 | AD recalled a prior incident involving a water glass on a counter in the office that fell and broke on the floor, however; according to AD, staff quickly cleaned up the broken glass and children were not near the hazard; and no injuries of children were reported.
The statements S1-S4 provided did not support claims related to the allegations. S1-S4 expressed the facility was adequately staff, children were never left unattended, and facility management were available to provide additional support/supervision in the class if needed. S1-S4 did not witness or have any knowledge of the incident related the broken glass in the office, S1-S3 said they had not seen any accessible hazards in the classroom; and S2 explained all cleaning compounds were locked in a cabinet.
C1-C9’s statements did not report any concerns and C5 & C8 confirmed when children played outside, staff were present to ensure everyone followed the rules. Although multiple statement did not report concerns, C1 & C9 suggested staff left child(ren) alone on the playground. A3 & P1-P5 said they noticed the facility had adequate staff to supervise children during indoor & outdoor activities, parents had not seen child(ren) unattended; and parents did not have concerns related to supervision. A3 & P1-P5 described when they dropped off/pick up their child(ren), they did not see any hazards or condition(s) that would jeopardize children’s safety. During LPA’s visits to the facility, LPA did not see evidence to support claims related to violation of supervision requirements and/or building and grounds. Based on this investigation, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
Exit interview conducted and report was reviewed with the Center Director, Stephanie Yamato. There were no violation(s) of the California Code of Regulations, Title 22; Division 12, observed. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in a $100 civil penalty. Appeal Rights were provided. |
