32 | LPA Friese conducted interviews with two staff (S1-S2) and 4 children (C1-C4) on 5/30/24. Both staff described the situations with C5 consistent with the Director’s statements. S1 stated that parents had been complaining, angry and reporting issues to staff about C5’s behaviors. S2 stated that the classroom is safe for all kids, some need extra supervision currently, and that they are “not quick to kick kids out”. S2 referred to the plastic bottle incident as an accident. C1-C4 all mentioned C5 when asked general questions about how they liked or didn’t like daycare. C1 teared up and said that C5 “yells and lies”. C2 likes daycare except for C6 who is “mean”, C3 stated that C6 was “kind of scary” and described an incident where C6 accidentally hurt another child (C7) when pretending to put handcuffs on him. C4 said sometimes things get “wild” and described the incident where C6 was hit in the head by C5 with the plastic bottle.
LPA Friese interviewed 3 parents (P1-P3) on 6/3/24 and 6/4/24. All parents interviewed reported that they had no concerns about safety or supervision of the children in care and stated that their children had never mentioned any unusual incidents. None reported unexplained or preventable injuries. P3 noted that he felt his child was being bullied recently, mentioned it to a teacher and the staff addressed it immediately and appropriately.
LPA Friese obtained and reviewed the Center’s curriculum goals, policies on dis-enrolling and difficult behaviors, as well as incident reports specific to C5.
Based on the information obtained by interview and record review, there were no unexplained or preventable injuries reported by staff or parents, therefore LPA Elizabeth Friese could not determine that staff did not prevent a child from injuring another child. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted with Assistant Director Regina HIrang, and appeal rights were provided.
