Licensing Program Analyst (LPA), Melchisedeck Augustin made an unannounced complaint-investigation visit and met with Licensee (LS), Allison Roerden, for the purpose of delivering findings for the above allegations. LPA, Hernandez-Torres previously met with LS on 07/18/23 to initiate the investigation by discussing the purpose of the visit, conducted an interview with LS, made observations at the facility; and requested a facility roster of the children in care. LPA, Augustin subsequently met with LS on 09/29/23 to conduct further interviews with staff and children, and reviewed children’s records. It is alleged that the Licensee did not prevent inappropriate interactions between daycare children and Licensee did not follow reporting requirements. The report noted a child made other children pull their pants down and rubbed their bottoms together and LS did not notify parents of the incident.

LPA, Hernandez interviewed LS on 07/18/23, and starting from 09/29/23 through 10/10/23, LPA, Augustin interviewed three staff (S1-S3), four children (C1 & C3-C5), three adults (A2-A4) and eight parents (P1-P8). Some children were not verbal, too young to interview, or did not qualify to be interviewed. (Continue to LIC 9099-C)

LS reported two incidents involving children pulling their pants down, and according to LS, she did not witness the incidents. LS described over a year ago, staff told her they noticed multiple children were dancing, pulled their pants down and recited, “Oh booty bump”, while they waited in line to use the bathroom, and staff asked children to pull their pants up, and in April 2023, children also pulled their pants down after LS and parents agreed to an unsupervised after hour play date between C1, C3-C5 in the backyard. According to LS, she learned of the incident when C3 ran in the home to notify her, which prompted LS to run to the yard where she noticed the children had their pants up; and LS firmly spoke to the children about the importance of privacy. There are indications which suggest LS may have informed the parents that staff would not be present to supervise the children, and supervision would be lax. LS described a third incident that occurred approximately one and half years ago, where multiple children including C1 & C4 were sitting on the patio steps, C4 went in the home and obtained scissors, returned to the yard, and cut a small portion of C1’s hair. LS claimed at that time, she sat on a chair in the yard but was distracted on her laptop. LS informed that the children did not have access to any sharp items, and scissors were kept in the Willow room on the art shelf. According to LS, staff always supervised the children in/outdoors, in the bathroom and backyard, and LS did notify some parent(s) of the incidents.

Statements provided by S1-S3 did not report any concerns related to lack of staffing and/or lack of supervision, and staff stated the children were never left without staff supervision and during the facility’s operating hours from 7:30am-5:00pm, there were at least two staff supervising the daycare children; and S1-S3 confirmed they were not present and did not witness incidents related to the after hour play date, and S1-S3 never saw any child asking other children to pull their pant(s) down. When children played in the backyard, staff scattered and walked around, and if staff noticed children entering an area with limited visibility, staff encouraged the children to return to an area where staff could see them. The procedure for reporting incident(s) was for staff to document the incident and notify parents via text or an online application called Telegram. The children, adults (A2-A4), and parents (P1-P8) did not report any concerns related to inappropriate interactions between children, and confirmed they always saw staff actively supervising the children, they never saw any child(ren) left unattended; and parents stated their child(ren) did not disclose any concerns to them and confirmed the facility notified them of incidents. Three statements noted concerns, and P1 reported a lack of supervision after seeing children left alone to play in the backyard, while A2 felt there was a lack of staffing at the facility. Based on the investigation, there was no conclusive evidence to support the allegations. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. There were no violation(s) of California Code of Regulations, Title 22, Division 12 cited at this time. Appeal Rights were provided.
