Licensing Program Analyst (LPA) Elpidia Hernandez Torres conducted a subsequent complaint investigation visit with center director for the purpose of delivering complaint investigation findings. It has been alleged day care child sustained injury while in care and Parents/Guardians are not allowed entry into the classrooms.

During the initial investigation an interview was conducted with three staff (S1-S3), 5 children (C1-C5), and 6 guardians (G1-G6) between 08/23/24-11/05/24. On 08/28/24, S1 reported the following drop off procedure: guardians arrive and stay in the lobby with the children, then staff from the classroom will pick up the child in the lobby. S3’s interview revealed the drop off procedure changed, and the current procedure is for guardians to wait in the lobby, but they were allowed to enter the classrooms in the past. One guardian reported they were told they had to wait in the lobby and couldn’t go to the classroom directly to pick up their child.

Three other guardians revealed they were never stopped from going to the classroom to pick up their children, but it depends if they are in a hurry or not, if they will take the extra time to walk their children to the classroom, or just have other staff take the child to the classroom. Another guardian reported they have never been stopped from entering the classroom, but the center will have them wait in the lobby until a staff brings the child to the lobby. Three children interviews revealed staff take them to their classroom while two children reported their guardians take them to their classroom. LPA received a copy of a memo sent out to guardians in the summer, dated 06/27/24 stating, ”effective immediately we kindly ask all parent/ guardians to remain in the lobby at the time of pick up. The learning center staff will bring your child to you.” Staff claim guardians aren’t forced to stay In the lobby. While LPA was present on 10/24/24, LPA observed guardians entering the preschool area to pick up kids from the classroom.

On 08/28/24, S1 stated there was an incident that occurred the week of 08/19/24, where a child accidentally smashed their fingers in the door of the large classroom that leads to the playground. S1 could not identify which staff were present or any more details of the incident. S2 reported the staff that was present during the incident with the fingers being smashed is no longer working at the facility. S3 reported a lot of staff were out sick, and they didn’t see the incident but corroborated a child’s fingers were smashed by a door in the preschool. Three guardians did report their children were injured while at the facility and that some guardians reported the injuries were from their rambunctious children, while others reported that the staff present when their child had gotten injured is no longer present at the center. Three children interviews revealed children get hurt from falling outside, and the teachers clean them up then place a band aid if they bleed.

On 08/28/24, LPA reviewed a copy of incident report given to guardians regarding an incident that occurred on 08/19/24 where a child’s fingers got caught on the door jam. LPA reviewed further evidence that showed staff had entered the classroom from the side yard and closed the door behind them. The door wouldn’t close so the staff looked to see a child was standing by the doorknob on the outside of the door. From the outside point of view, there were two children by the door, one child close to the hinges of the door and one close to the doorknob side of the door. The child close to the doorknob placed the child by the hinges of the door out of sight of the staff on the inside of the classroom who was attempting to close the door, resulting in the child by the hinges getting their finger caught in the door as the staff attempted to close it.

Based on interviews conducted and records reviewed, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violations occurred, therefore the allegations are Unsubstantiated.
