25 | On 08/06/2024, Licensing Program Analyst (LPA) Leibert conducted an unannounced case management visit and met with Rosauro Sabile to follow up on a substantiated allegation of neglect/lack of care and supervision resulting in a resident sustaining severe injuries.
On July 28, 2023, the Department concluded a complaint investigation which alleged neglect/lack of care and supervision resulted in a resident sustaining severe injuries.
The licensee was cited for violating California Code of Regulations (CCR) Title 22, §87466 - Observation of a resident (R1) when R1 developed multiple pressure injuries and an unstageable severe traumatic injury to R1's right wrist/hand resulting in amputation.
At the time of the complaint visit on July 28, 2023, an immediate civil penalty of $500 was issued and the licensee was informed that an additional civil penalty was still being determined and might be assessed based on Health and Safety Code §1569.49.
The Department has concluded an analysis and has determined that a civil penalty is warranted for serious bodily injury. Per Welfare and Institutions Code §15610. 67 defines serious bodily injury as “an injury involving extreme physical pain, substantial risk of death, or protracted loss or impairment of a function of a bodily member, organ, or of mental faculty, or requiring medical intervention, including but not limited to, hospitalization, surgery, or physical rehabilitation.” This is evidenced by the Licensee failing to obtain timely medical care for R1. The Licensee’s failure to seek timely medical care caused the resident to suffer serious bodily injury which required hospitalization and surgery. According to medical records, R1 was sent to the medical center for medical attention on March 10, 2023, after the facility observed R1 to be bedbound without energy for two days. Upon admission to the medical center, R1 was assessed and observed to have a total of seventeen wounds; including multiple pressure injuries, a stage one pressure injury to R1’s right hip, and an unstageable severe traumatic injury to R1’s right wrist/hand, which resulted in amputation of R1’s right hand.
Today, 08/06/2024, the Department will be issuing a civil penalty per Health and Safety Code§1569.49 for a violation that the Department constitutes as serious bodily injury in the amount of $10,000. However, since an immediate civil penalty of $500 was previously issued on July 28, 2023, the amount of the civil penalty issued today will be $9,500.
