32 | A review of the Face-to-Name Transition sheets dated 04/09/24 indicate what staff signed in as present in the Two’s room. A review of the Staff Rest Period Log dated 04/09/24 indicates which staff took breaks between 10:00am and 11:00am and could have walked through the Two’s room, a centrally located room in the facility. Staff interviews included, but were not limited to, staff present in the Two’s room or who staff who took a break on the alleged date, during the alleged time.
On 04/16/24 D1 denied the allegation, stating that she has never witnessed a staff yell at the children. S2 and S4 stated that although they have heard staff raise their voices, they have not witnessed yelling, just a loud voice or a raised voice to get a child’s attention. S1 and S3 admitted that they have yelled at the children but could not give specific dates or who they yelled at. S1 stated that they would consider their raised voice to be yelling, because they are not vocal cords they normally use, yelling due to the children not listening . S3 stated that they have yelled because the children weren’t listening to them, maybe a couple of times, stating that although they don’t like to yell, sometimes they get angry. On 05/02/24 S5 admitted to hearing staff use stern tones of voice but did not consider it to be yelling. S6 stated that they have never heard yelling. S7 stated that they have not heard staff yell, only sharp quick words for safety. During the interview with A1 on 06/27/24, they stated that they have heard a lot of yelling in the 2's room, stating that it was hard for them to remember what exactly was said, but noting that it wasn’t just raised voices to be heard or to get a child's attention for safety. They stated that what they heard was yelling at a child or children because they weren't doing what the teacher wanted them to do. They stated that S1 was heard yelling something like, "Why aren't you cleaning up, you're supposed to be cleaning, why aren't you?", said in anger and frustration.
Based on interviews conducted with A1 and S1 and S3, there is a preponderance of evidence that staff, including S1, have yelled at children in care on more than one occasion, which may have included the alleged date of 04/09/24. S1 and S3 both admitted that they have yelled at children in care, therefore the allegation is SUBSTANTIATED. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided.
Exit interview conducted, and report was reviewed with Facility Representative, Director, Sarah Morrison.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
