An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst Y. Yang to present the findings of the investigation. The complaint alleged that the facility failed to ensure preschool-aged children’s needs were met. Specifically, it alleged that on multiple occasions children in a preschool classroom were visibly distressed and crying, exhibited untreated runny noses, and were not cleaned after eating or playing. In one instance, it was alleged that a staff member (staff S3) reportedly ignored the children because the staff member was preoccupied with an iPad in the classroom.

The LPA met today with the center’s newly appointed director, Nicole Del Calvo, to review the investigation findings. During the LPA’s initial visit on June 4, 2025, the former director, Kylie Richardson (staff S1), was interviewed regarding the allegation. Director Richardson denied the allegation and explained that preschool classrooms can appear chaotic during morning drop-off, particularly when newly enrolled children are still adjusting. She stated that the atmosphere typically calms once children settle in and noted that children’s behavior may vary when an authorized representative is present. Director Richardson reported that staff routinely wipe children’s noses and faces, and change soiled clothing as needed. (Continued on LIC9099-C)

She acknowledged that after meals or activities, several children may require attention at once, and staff respond to them individually. Director Richardson stated the staffing ratio in the classroom referenced in the complaint was 1:10. Furthermore, Director Richardson acknowledged speaking with staff S3, who confirmed using the classroom’s iPad to sign children in but denied ignoring the children during that time. Verbal coaching was provided to S3, with a reminder that active care and supervision must take precedence over administrative tasks.

A follow-up visit occurred on July29,2025, during which the new director, Nicole Del Calvo (staff S2), was interviewed. Director Del Calvo clarified that her first official day as director at the center was June23,2025. She likewise denied that the childrens needs are not met and reported that staff under her supervision provide an adequate level of care and supervision. She confirmed that classrooms may appear chaotic depending on the time of day, but they function normally once children settle. Director Del Calvo added that walkie-talkie radios are utilized in every classroom, allowing teachers to request additional support from other available staff or the front office.

Throughout the investigation, the LPA conducted unannounced visits on June4, June20, July29, and August 6,2025. Observations inside classrooms and interviews with staff members S1 through S15 and with children in care revealed no corroborating evidence supporting the allegation. Staff interviews aligned with both former and current directors statements, indicating that childrens needs are being met, though some staff acknowledged there is room for improvement. Client interviews likewise yielded no corroboration. During classroom observations, the LPA saw that teachers attended to all children, supervising and engaging them, changing diapers, assisting with toileting, and comforting upset children as needed.

Based on available information and interviews conducted, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegation is determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the center director, Nicole Del Calvo. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
